Currituck County Wills
In the name of God, Amen. I William HUNNINGS of Currituck County in the State of North Carolina, being weak in body but of sound disposing mind and memory, do make this my Last Will and Testament in the manner and form following. I give and recommend my soul to Almighty God who first gave it me and as touching such worldy estate wherewith it hath pleased God to bless me with in life, I give and devise and dispose of in the following manner and form:
Item: I lend to my dear and loving Wife during her widowhood the use of all my cultivated lands, with the building thereon, her raising and keeping clear of expence my four youngest children untill they come to lawful age.
Item: I give to my two Sons Zachariah HUNNINGS and Elijah HUNNINGS all of that tract of land and plantation I bought of Thomas SIMMONS laying on North River, to be divided equally between them, to them and their heirs forever.
Item: I give to my two Daughters Peggy HUNNINGS and Betsey JARVIS my land and plantation on the west side of the main road commonly called the GIBSON Plantation to be equally divided between them, my Daughter Betsey JARVIS to have the north end of said land, to them and their heirs forever.
Item: I give to my Daughter Sally HUNNINGS the part of my plantation whereon I now live, that formerly belonged to James WALLS agreeable to the lines that said WALLS held it by and joining Thomas WHITEHALLs land, to her and to her heirs forever. Containing about fifty seven acres more or less
Item: I give to my Daughter Abbey HUNNING that part of my plantation whereon I now live, which I bought of Thomas WHITE and Wife, agreeable to the lines they formerly held it by, containing fifty seven acres more or less to her and her heirs forever.
Item: I give to my Son Riddick HUNNINGS that part of my land and plantation I bought of Zepheniah SAWYER agreeable to the lines that he held it by as will appear by deed from said SAWYER, containing about fifty seven acres more or less to him and his heirs forever.
Item: I give to my Son William HUNNINGS that part of my land and plantation which I bought of Thomas GRAY and Wife agreeable to the lines they held it by as will appear by deed from said GRAY and Wife, containing fifty seven acres more or less, to him and to his heirs forever. It is my will and desire, that if either of my two Sons Riddick HUNNINGS or William HUNNINGS should die before they have an heir lawfully begotten of his body that his part of said land should go to the surviving one. It is further my will and desire that if either of my two Daughters should die before they should have and heir lawfully begotten of her body that her part of the land above given land should go to the surviving one, I mean my two Daughters Sally HUNNINGS and Abbey HJUNNINGS.
Item: I lend the use of all my perishable property (money and notes and accounts excepted) to my Wife during her widowhood and if she should marry or dissent from this will, I give all the said perishable property to all my children and Wife, to be equally divided, to them and their heirs forever.
Item: I give to my two Sons Zachariah and Elijah HUNNINGS one hundred and fifty dollars out of my notes to be equally divided between them, to them and their heirs forever.
Item: I give to my Wife my negro woman Chainey to her and her heirs forever.
Item: I give to my two Sons Riddick and William HUNNINGS and my Daughter Sally HUNNINGS all the remainder of my property and estate of any kind whatsoever, which I have not already given away after paying my just debts, to be equally divided between them (excepting during my Wife widowhood she should be under the necessity to repair this house I now live in or build another small dwelling house not to exceed twenty feet in length and sixteen feet in breadth with a shed) then and in that case she should have as much of the above estate or money as should repair or build the said house, the house if built shall be put on my Daughter Sally HUNNINGSs land.
Lastly I do hereby nominate, constitute and appoint my friend Thomas SAUNDERSON, to be my whole sole Executor of this my Last Will and Testament, hereby revoking and disannulling all former will or wills heretofore by me made, ratifying and confirming this and no other to be my Last Will and Testament. In witness whereof I have hereunto set my hand and affixed my seal this 10th day of January 1818.
