Minutes of March Court 1808

Ordered that Demetrius Young constable of the Grand Jury be allowed
forty shillings for his attendance at this Term- and that the
Collector pay the same the allowed

A Deed from James Murry Excr&c. to Abram. McLamore was proved by the
oath of Lewis Webb, & on M.O.R.-

A Deed from Hardy Hunt to John Mills was provd by the oath of Lewis
Webb & on M.O.R.

Ordered that Claiborn Cook be appointed Guardn. to James Bowers, a
lunatic, son of Phil Bowers decd. who entered into Bond in the sum
of five hundred pounds with Thomas Yarbrough & David Bowers his
Securities-

No 43 State vs. Negroe Dick} Charge for Burlary & House breakfast}
Jury Sworn & charged. Same as in no 35- who find the Defendant not
Guilty Of the Burglary as Charg'd in the first Count but find him
Guilty of the Larceny as Charg'd in the second Count of the Bill-
The Court adjudge that the Defendant receive thirty nine lashes,
will Said on, upon his bare back that he branded with a red hot iron
on the right cheek with the letter R &on the left Cheek with the
letter T and that the Sherriff carry his Judgement into execution on
Saturday next between the Hours of twelve & two oclock and that the
said dick stand committed till all costs are paid-

Ordered that James Milner be allowed Two Hundred & Seventy five
pounds for rebuilding &c the Goal of this County & that the Collector
pay the same and be allowed in his Settlement of the County Tax. The
CommiSsrs. appointed to let the rebuilding thereof having exhibited
a receipt in favour of the undertaker

Minutes of June Court 1808

No 33 Wm. Bowden aSsence&c vs. Jno. F. Foster} Debt- same Jury as in
No. 29, who find the Bond to be the act & deed of the Defendant,
that there are no payment nor set offs, that the Virginia money
therein mentioned is of the value of L35"5'4" and aSseSs the pltffs
damages L9"10"s & costs-

& Benj Sherrod} Debt- Same Jury as in No 29 who find that there are
no payments or set offs, that the Virg. Money in the Bond mentioned

9 & costs.

Junr} Covt. Same Jury as in No. 29 who find that there are no payments
or Set offs [the following is scratched out- That the dollars in the

Ordered that the following persons be appointed Jurors to attend next
Superior Court to wit, William Ransom, Person Sledge, Benjamin Ingram,
Altha Thomas, Cordy Ferrell, Frances Taylor, Brillam [or Brittain]
Harris, Benjamin Waddel, Benjamin DoSsey, Mills Robbins, Benjamin
Sherrod, James Collins Jr, Jonathan Done[?], John Perry (Shick)
William Leonard, James Harris, Nathaniel Macon, Stephen Pearce,
Edward Finch, Phillip Pearce, BraSsell Strickland, John Harris,
Charles A Hill, William Williams (Bl) Samuel Taylor, John Hudson,
James Murfree, Henry Baker Jr, Jackson Lile, Eppes Moody, & that the
Sheriff summon them accordingly-

Ordered that Thomas King[?] be appointed Constable in &for the County
of Franklin for one year who entered into Bond according to Law, with
Joel King & Nathan Patterson his Securities.

No. 7 Joseph M. Myers vs. William Arrington} Debt. Jury charged to wit,
Jno. Person, Joseph Smith, Turner Bobbett, Sion Kimball, Joel Sledge,
John Webb, Howell Underwood, Archibald Yarbrough, Willis Boon, Joshua
Jones, Atkins Nicholson, John Walkins who find that there are no
payment or set off that the Virginia money declared upon is of the
value of L360"1"8 and aSsess the pltffs damages to L66.8"6 &costs-

oath of Benjamin Brickell Esqr. and on M.O.R.

A Bill of Sale from Patsey Hackley to Joshua Perry was proved by
the oath of Richard Hale[or Hall] and on M.O.R.

Orderd that Jeremiah Portes be appointed overseer of the road in the
room of Benjamin Williams and that he keep the same in repair with
the usual hands

Orderd that Jordan Hill, Joel King and Nathan Patterson examine and
audit the accounts of Presley C. Person County Trustee and report &c

A Deed from Richard Jones to Jordan Denson was proved by the Oath of
Giden Glenn Esqr. and on M.O.R.

A Deed from William Gill and Polly his wife to Nathaniel Nicholson
was exhibited, and the said Polly being a feme[or firm] covert [or
cosert] being privily examined according to Law, and the deed being
also duly acknowledged by the said William Gill & Polly his wife &
is on M.O.R.

Orderd that Joel Rivers, Josiah Thomas and Richard Hill be
commiSsioners to let the building a bridge aCroSs Sandy Creek at
BaSses and report

Orderd that Richard Hill (DB) Charles Gant and John [sic] be appointed
commiSsioners to let the building a bridge acroSs Red Bud near Sill's
Mill and report &c

Court adjourned till tomorrow 9 oclock

Wednesday morning Court met according to adjournment, present-
William Lancaster, Francis Pugh & Benja. Brickell Esquires

Jeremiah Perry (ridge) vs. John Hall} On motion Judgement is granted
against the defendant for L70"5"1 and costs being monies paid by the
said as security for the defendant.

The account of Joel Rivers Executor&c of Thomas Butler decd was
exhibited being examined by the commiSsioners appointed for that
purpose &on M.O.R.

No. 25 Lewis Bond vs. Anlington[?] Richardson & others} Covt. Jury
charged ,to wit, Sampson Wiggins, Matthew Medlin, John Pippin,
Allin Hines, Benjamin Hunt, John Babb, Ebin Nelms, George Tunstall,
Michael Ely, James Yarbrough, William Connelly and John Douglas, who
find all the iSsues in favour of the plaintiff and aSseSs his damages
to L103"13"1 and costs.

Green Hill ackd. Themselves security for stay of Execution agreeable
to last Suspension Law.

Ordered that William Brickell be appointed overseer of the road from
the crooked sourwoods[?] to the town line near Doct. Verrells and
and [sic] that he keep the same in repair with the hands of Nicholas
Long and his own

Ordered that Henry Arrington and Micajah Bridges to whom were bound
Thomas Batchellor and Peyton Batchellor Orphans &c be rebound from
their Covenant or Indentures with the court

No. 17 FiSs.iSsd.[?] William Connelly vs. William Thomas} Edward
Lansil and James J. Hill ackd. themselves Security for the stay of
the Execution in the Case agreeable to Law for the suspension &c.

ISs'd Ordered that Charles Debnam be allowed forty shillings for 4
days attendance as the constable of the grand Jury and that &c

days attendance as Constable of the Court and that &c.

A Receipt from Beverly Daniel by his agent Robert H. Jones to
Archibald Davis, was proved by the oath of John E. Denson & on M.O.R.

Ordered that Michael Eley's hands work under him as overseer of the
Road

Ordered that Robert A. Wynne be appointed overseer of the Road in
room of William Thomas and that he keep the same in repair with the
usual hands & the hands of Nicholas Murphey.

if they think proper the old Road from William Williams by Benjamin
Perrys Mill to the County lines near Nelm's old place and report to
next court

ISsued Ordered that John Hays junr Miles Hicks John Perry (thicket)
William Gill and William Waddell be appointed patrolers in Captain
Perrys district for one year

ISsued Ordered that JoseSs Bledsoe William Woodard Nicholas Murphey,
Richard Hall and Aron Bledsoe be appointed patrolers for Captain
Ingrams district for one year-

ISsued Ordered that Marmaduke N. Jeffreys Henry Benton and Benjamin
Sherrod be appointed patrolers for Captain Cooks district for one year

ISsued Ordered that John Douglas be appointed overseer of the stage
Road in the room Young Dickerson and that he keep the same in repair
