Will of HARDY M. JONES-1873

Halifax County Probate Court 1873

I HARDA M. JONES of the county of Halifax and State of North Carolina do make and declare this to be my last will and testament in the manner and form as follows:

Item th 1.   I loan to my wife MANERVY every thing that I possess as it stand at my death and after death of my wife I give to my gran daughter MARY CURTIS one third of my land including my dwelling house to her & her heirs for ever.

Item th 2. and the other two thirds I give to SARINA DANIEL & CANDIS MEACHAM to be equally divided between the two.

Item 3d.   I give to ANDREW DANIEL at my death my double barrel shot to him and his heirs for ever also my shoe bench and tools.

I appoint my wife MANERVY JONES my executor to carry in to effect this my last will and testament and to pay my funeral expenses and all my just debts to whom so ever owing.

In witness I have her unto set my hand and
seal the 19th day of Septr. 1872.

The foregoing paper writing purporting to be the last will and testament of HARDA M. JONES, deceased is exhibited for probate in open Court, by MANERVY JONES, the Executrix therein named, and the due execution thereof by the said HARDY M. JONES is proved by the oath and examination of A. G. GREEN and J. W. JOHNSTON the subscribing witnesses thereto.
It is therefore considered by the Court that the said paper writing and every part thereof is the last will and Testament of the said  HARDA M. JONES, and the same is ordered to be recorded and filed.
And therefore the said MANERVY JONES the Executrix as aforesaid comes and is duly qualified as such, by taking and subscribing the oaths prescribed by Law.  March 10, 1873.

#168- (176) - 6 Mar 1873.  MANERVY JONES testified that HARDY M. JONES died with will. Estate valued at $225 -250, including 25 acres.  Heirs: Sd HARDY M. JONES' children, namely THERESA DANIEL, CANDIS MITCHUM; granddaughter MARY CURTES a minor.   MANERVY JONES.  Appointed.

In the Matter of the Will of HARDY M. JONES
Before JOHN T. GREGORY, Judge of Probate

MANERVY JONES being sworn doth say: That HARDY M. JONES late of said County, is dead, having first made and published his last Will and Testament; and that the said MANERVY JONES is the executrix named therein.
Further that the property of the said HARDY M. JONES consisting of about twenty five acres of land situate in Halifax County, and personal property, which is worth about $225.80 far as can be ascertained at the date of this application; and that THERESA DANIEL, CANDIS MITCHUM, children of the said Testator and MARY CURTIS, granddaughter of said Testator the last named under twenty one years of age and without guardian & all residing in Halifax County are the parties entitled under said will to the said property.

Sworn to and subscribed before me, this 10th day of March 1873.

And thereupon the said MANERVY JONES is appointed Executrix of the said HARDY M. JONES and qualifies as such by taking and subscribing the oaths prescribed by law, and Letters Testamentary issued her accordingly, March 10th 1873.
