Wiley had moved from Hyde Co., NC to White Co., TN by 1830 where he 
married and began raising his family.  Around 1857 he moved his family 
to Saline Co., IL.

1. James McGOWAN (1841-1927) m1st Amanda Melvina MARTIN (c1850c1874); 
m2nd Eliza Ann EATON (_?_-1878); m3rd Lilly Agnes SHANNON (1867-1946). 
After the Civil War he moved from Illinois to Arkansas, Missouri and 
finally Kansas.

2. John McGOWAN (1842-1914) m Marinda ROBERTSON (1847-  ? ). After 
the Civil War he moved from Illinois to Arkansas, Missouri and finally 
Oklahoma.

3. Mary McGOWAN (1851-_?_) m 1st James BANES/BAINS (_?_-by1880), m2nd

The Plantiff Allege:

1.  That Henry McGowan died intestate in the County of Hyde and State of 
North Carolina about the 15th day of Jany. 1882 seized and possessed of 
a certain tract or parcel of land being in said County in Swan Quarter 
Township containing Fifty acres more or less & bounded and described 
as follows, to wit:  On the North by Heron Bay, on the east by C. S. 
Boomer's land, on the South by the back line of Clayton's Patent and on 
the West by the lands of A. B. Swindell.

2.  That the plaintiffs above named & the defendants are seized as 
tenants in Common of the lands above described as follows:  The heirs of 
Levi McGOWAN above named are seized of one sixth between them, each being 
seized of one third of one sixth; the heirs of Isaac McGOWAN each being 
seized as above set forth; the heirs of Rebecca CARAWAN being seized as 
above set forth; the heirs of Sally BOOMER each being seized of one half 
of one sixth; the heirs of Wm. McGOWAN each being seized as above set forth; 
and the defendants, the heirs of Wiley McGOWAN each being seized as above 
set forth.

3.  That owing to the smallness and diversity if interests in said land 
of which the said tenants in Common are seized the land is incapable of 
an actual division.

4.  That the defendants are non-residents of North carolina and reside in 
the State of Illinois.  Whereas the plaintiffs pray that the defendants 
be made defendants by advertisement according to law and that the lands 
be sold under the order & decree of the Court and the proceeds of sale 
after paying the Court of this proceeding be divided among the said tenants 
in Common according to their interests therein.

C. S. BOOMER being duely sworn says:  That he is the agent and represent-
ative of the plaintiffs herein.  That the facts set forth in the Complaint 
are true of his own knowledge.
