. . . On this 24 July 1855, personally appeared before me, a Justice of the Peace within and for the county and state aforesaid, Richard Midyett, aged 60, a resident of Hyde County, was duly sworn and declares that he was a private soldier in the company commanded by captain Pharoah Farrow in the 1st Regiment of N.C. Detached Militia in the war with Great Britain declared June 18th 1812; that he entered the service at Chickamacomico, on the South Bank on or about the 25th day of June 1812, for the term of the war and continued in actual service and was honorably discharged at Chickamacomico, South Bank, on or about the 30th day of July 1812. He had no discharge certificate.

. . . I, Joseph Quidley, citizen of the county & state aforesaid, having been first duly sworn, depose and say that I was a private in the company of Captain Hillory Bell in the 1st Regiment of N.C. Detached Militia commanded by (nothing written in) in the War of 1812 with Great Britain; that I knew Captain Pharoah Farrow who commanded a company of militia in said war in said regiment which said company belonging to said regiment and commanded as above stated by Captain Pharrow Far [sic] and stationed on the beach to guard the coast between New Inlet and Ocracoke Inlet and while as stationed the said company captured several English barges and made 14 prisoners who were attempting to force their way through New Inlet. I further depose that I knew Richard Midget, Solloman Pain and William Weatherington who was Privates of Captain Pharrow Fare's [sic] company during the time aforesaid and was in the company during the whole service along said beach which service during the years of 1812, 1813 & 1814 at the several times the company was sold out and rendered military duty embraced a service of 34 days or more belonging to the same regiment and meeting with this company often at New Inlet when on duty and being well acquainted with Richard Midyett, Solloman Pain and William Weatherington enables me to testify with certainty as to the facts herein embodied. I further depose and say that as a private in the company of Hillory Bell I have received for my service under the Act of Congress of March 3rd 1855, 160 acres of land which I have sold the said warrant, do not positive recollect the number of the warrant but to the best of my recollection it as 48266 but not positive of it. I further depose and say that I have no interest whatever in the application of the above Richard Midyett, Solloman Paine and William Weatherington for land bounty.

Sworn to on March 15, 1860 in the presence of J.A. Midyett, J.P. (on April 25, 1860 W.W. Spencer, Clerk of Court for Hyde County, certified that Jethrow A. Midyett, Esq. was an acting Justice of the Peace for Hyde County.)

Affidavit

On April 27, 1860 a very similar deposition as the one listed above was taken from Markey Harris of Hyde Co, a Private in Captian Hillory Bell's Company. He states that he received 120 acres and another 40 acres (warrant #99883) for his services during the war.

. . The enclosed depositions of Joseph Quidley and Marky Harris of the military service of Richard Midgett, Solomon Pain & William Weatherington, privates in the company of Capt. Pharroah Fare [sic] of the N.C. Militia in the War of 1812, have been sent to me to fwd. to the office of the Com. of Pensions with instructions to prosecute their claims. From what I learned, the above parties applied for bounty land warrants under the act of March 3, 1855--sometime after the passage of the act of that year or during the year 1856, as privates in the company of Capt. Pharrow Fare, but the rolls of that company not being found at the auditor's office, their applications were suspended and they have proved their service as prescribed in such cases. The nos. of their applications nor the time when made have not been furnished but the same may, I presume, be very readily found in the register of applications.

On this 13 day of May 1878 personally appeared before me Pheby Midgett, aged 80 and a resident of Chickamacomico, N.C., and declares that she is the widow of Richard Midgett, deceased, who served as a private in the company commanded by Captain Farrow Farrow; that her husband enlisted at Chickamacomico on or about December 10, 1813 for the term of 3 years and continued in actual service for the term of 35 days, and whose services terminated by reason of honarable discharge at Chickamacomico on January 15, 1814. She further states that the following is a description of her said husband at the time of his enlistment, viz: age 19 years, 4 months & 5 days; carpenter of Chickamacomico; 5'8" in height; dark hair and dark eyes; dark complexion. She further states she was married to Richard Midgett at Chickamacomico in Currituck Co., N.C. on March 30, 1816 by Banister Midyett, J.P. and that her name before her said marriage was Pheby Midgett and that she has not remarried since the soldier's death. She states that she nor her husband has never been married before nor since and that her husband, Richard Midgett, died at Chickamacomico on October 7, 1877. She states they had been living at Chickamacomico from the time of his discharge until his death.

Affidavit

Edward Paine, Sr., age 81 and a resident of Chickamacomico in Dare Co., N.C., states he has known Pheby Midgett for 65 years and that her husband, Richard Midgett, served in Capt. Farrow Farrow's Company in the War of 1812. He states he was well acquainted with them before his enlistment until the time of his death.

Personally came before me Edward Paine, Sr. and Cordelia Midgett, citizens of Chickamacomico in Dare County, and declare as follows: that they were at Richard Midgett & Pheby Midgett's marriage and saw them when they were joined together and that they lived on the same place until his death on October 1, 1877 and the witness certifies that she has not been married since the death of her husband and that there can not be any family record found whatever. Edward Paine, Sr. & Cordelia Midgett do certify that they heard the ceremony and that they were married by a Justice of the Peace; that these are the ages of their children: first was born July 29, 1817, second was born Feb. 1, 1819, third was born January 16, 1821. Edward Paine, Sr. & Cordelia Midgett do certify that we have been living on the same place ever since they were married and remain. We the undersigned do certify that we have known them for 75 years. We know the time that they have been married by our own marriages. I, Pheby Midgett, do certify that no higher or better evidence can be obtained. We, Edward Paine, Sr. and Cordelia Midgett certify that we have known them personally from children. (This deposition was sworn to by Israel B. Midgett, J.P. on July 15, 1878.)

She further states that the following is a description of her said husband at the time of his enlistment, viz: age 21 years; carpenter of Chickamacomico; dark hair and dark eyes; dark complexion. She further states she was married to Richard Midgett at Chickamacomico in Currituck Co., N.C. on March 30, 1816 by Banister Midyett, J.P. and that her name before her said marriage was Pheby Scarborough and that she has not remarried since the soldier's death. She states that she nor her husband has never been married before nor since and that her husband, Richard Midgett, died at Chickamacomico on October 1, 1877. She states they had been living at Chickamacomico from the time of his discharge until his death. I swear that by reason of infirmity of age I am unable to appear before the clerk of record.

Letter from Dept. of Interior

. . . . . You are respectfully requested to furnish official evidence of the enrollment, muster, service, duty, and discharge or death of Richard Midgett, who is alleged to have been enlisted at Chickamacomico on the 10th day od December 1813 in Captain Farrow’s Company of North Carolina Militia, and to have been discharged (or died) at Chickamacomico on the 15th day of January 1814. It the above name is not found on the rolls of said Company, will you so state and report as to enrollment, etc., in the case of any man bearing a similar name, whom you have good reason for believing to the soldier inquired for.

Letter from Phebe Midgett to J.A. Burky

Feb. 7, 1879 – Rodantha, NC

Dear Sir:
. . . . . In reply to your letter the way that I understand it that the power of attorney was to prosecute the clame and not to receive the warrant and I did not promise to pay him eny thing more than what the law alow him the law sayes that the attorney fee shall only be ten dollars and that is all that was said conserning it and is all that I expect to giv and I hav not promised to sell the warrant to eny won I wrot to R. MacAllister to now what the government would pay for it if issued and he said that they would giv one dollar per acre and if you pleas you will advise me whare I can sell it for the best price if I get it I would like to sell it for the money and hav it sent to me as I am unable to attend to eny business my self and have to get som won to do all of my business I hav got Edward Paine to do my business for me I hope to hear from you soon advise me what to do. [No punctuation was used in this letter and the words are spelled as they appeared in the original letter.]

Personally appeared before me Edward Paine, Sr., age 81 and a citizen of the town of Rodantha in Dare County, N.C., and swore that he was present at & saw the said Phebee A. Midyett and Richard Midyett, the said soldier, married and know that they have not remarried since, and know that the said Richard Midyett was a soldier and was instrumental in taking prisoners at New Inlet and I was called on to help guard them but I was not a soldier myself.

. . On this 18th day of October 1879 personally appeared before me Phebee A. Midyett, aged 82 and a resident of Rodantha, N.C., who swore that she is the widow of Richard Midyett who served as a private in the company commanded by Beverally Rew in the 2nd Regiment of N.C. Troops commanded by Lt. Col. Simon Burton in the War of 1812; that her husband enlisted at Hatteras Banks on or about January 21, 1813 for the term of the war and continued in actual service in said war for the term of the war and whose services were terminated by reason of close of the war at Hatteras Banks on February 14, 1815. She further states that her husband at the time of his enlistment was age 18, a fisherman of Hatteras Banks, 5'7" in height, dark hair, dark eyes and dark complexion. She states that they were married by Banister Midyett, J.P., on January 6, 1815 in Rodantha and that the name before her said marriage was Phebee A. Scarborough and that she has not remarried since the death of said Richard Midyett nor were they previously married to anyone. she states her husband died at Rodantha, N.C. on November 11, 1877 and that she and her husband lived at Rodantha from the time of their marriage until his death. She appoints Edward Paine, Sr. as her lawful attorney to prosecute her claim. She further declares that she has heretofore made an application for pension but through a mistake of the officer's names it was not granted and that her application was made last year in 1878.

Also personally appeared Benjamin S. Pugh, age 46 and resident of Rodanthe, and William Paine, age 57 and resident of Rodanthe, and swore that they have known the said Phebee A. Midyett for 35 years & 40 years respectfully, and that she was the wife of Richard Midyett who served under Captain Beverly Rew in the 2nd Regiment of N.C. Troops in the War of 1812 and that they have known her as long as they can recollect.
