The Last Will and Testament of
March 6, 1773-Sept. 1774
In the name of God Amen I JOHN DALY of the County of Pasquotank and province of North Carolina being sick and weak in body but of sound and disposing mind and memory doth make and ordain this my Last Will and Testament in manner and form following viz.
My will and desire is after death that my body be buried in a neat decent and christian like manner at the discrestion of my executors hereafter named.
Item: It is my will and desire that all my estate both real and personall should be sold at publick vendue by my executors hereafter named they giving six months credit taking bond with security for the amount of same, except Fifty acres of my juniper which adjoins the north end of John Chamberleens land, I give and bequeathe unto the said John Chamberlen his heirs and assigns forever.
Item: It is my further will and desire that all my just debts should be first discharged out of the amount of the sales of my estate and the overplus? I give in manner following
Item: I give and bequeath unto my Son JOSHUA DALY Forty shillings proc. money.
Item: I give and bequeath unto my Son ZADOCK DALY Forty shillings proclamation money.
Item: I give and bequeath all the residue and remainder part of my estate to be equally divided between my Two Sons JOHN and ENOCH DALY.
Item: I nominate an appoint my Son JOSHUA DALY and my friend Jonathan Hearring whole and sole executor to this my Last Will and Testament making null and void all other will or wills by me heretofore made ratifying and confirming this and no other to be Last Will and Testament In Witness whereof I have hereunto sett my hand and seal this 6th day of March 1773.

The Last Will and Testament of JOHN DALY was exhibited by JOSHUA DALEY executor therein named proved by the oath of Isaac Gregory in due form of law at the same time the said executor quallified by taking the oath by law appointed Ordered to be recorded
