The Last Will and Testament of

JOHN SMITHSON

1808

In the name of God Amen I John Smithson of the County of Pasquotank and State of North Carolina the twenty ninth day of September One thousand Eight hundred and Seven being weak in body but of sound mind and memory do make this my last Will and Testament in manner and form following to wit.

Item  I leave the use of all my Estate both real and personal to my loving wife Doritha Smithson during her life and after her decease my will is that my son John Smithson shall have all that I have given to my wife Doritha Smithson to him and his heirs forever. And as for my other Children namely, Elizabeth Frew, Reuben Smithsons heirs, Nancy Davis, Isaac Smithsons heirs, Matthias Smithson, Seth Smithson, Jemimah Davis, Isaac Wood, Aaron Smithson, Adam Smithson I leave them nothing.

And I do hereby nominate and appoint my son John Smithson my whole and Sole Executor to this my last Will and Testament Ordering him to pay all my Just debts and will to Execute this my last Will and Testament hereby revoking all former Wills by me made In Witness whereof I have hereunto set my hand and seal this day and Year above written.

March Term 1808. 

The last Will and Testament of John Smithson Esquire Deceased was exhibited in open Court by John Smithson the Executor therein named and proved by the oath of David Pritchard Junior one of the Subscribing Witnesses thereto, the said Executor appeared and qualified agreeable to Law. Ordered that the Will be recorded and letters Testamentary issue.
