Will of Solomon Davis, February 1798

(Note: This will was proved February 1810, Granville County Will Book 7, Page 460)

In the name of God Amen, I Soloman Davis of the County of Granville and State of North Carolina, being of sound mind of memory think proper to make and ordain this to be my last Will and Testament, in manner and form following.

Item ?) I leave unto my beloved wife Elizabeth Davis nine negros named Judah, Rachel, Isbel, Diamon, America, Cealey, James, Adam, and David with all their future increase give unto my son Joseph ? Davis, three negros named Violet, James, and David, which he is already processed of to him and his heirs forever.

Item) I give unto my son Absolom Davis three negros named Peter, Julee $ Spencer with all their future increase to him and his heirs forever.

Item) I give unto my grandson William Hunt two hundred and fifty acres of land part of the tract I now live on be the same more or less bounded as follows: beginning at the mouth of the lick branch running up the Sd. branch to the lick, thence a straight course to James Locks corner being on a white oak in a steep bottom, thence along Sd Locks line to Zachariah Hester’s line, thence along Sd Hester’s line to a sweet gum corner in Samuel Creath’s line, thence along Creath’s line to a white oak corner at my field, still continuing along Sd Creath’s line to a corner in James Satterwhite’s near a pond, touching on Thomas Parson’s line, thence along Parson’s line to Nichals Creek, thence along the Sd creek to the beginning to him and his heirs forever.

Item) I lend onto my daughter Messimiah Mitchell during her natural life all the remaining part of my land whereon I now live, not already devised, and if my Sd daughter Messimiah Mitchell should see cause for the Sd land to be sold, at any time in her life, my Executors hereafter named may have power to dispose of the land, and the money arising from such sale be equally divided between my three children named Joseph Tom? Davis, Absolom Davis, & Messimiah Mitchell, but provide my Sd daughter Messimiah Mitchell should think proper to keep the land during her natural life, my Will and desire is at her death for the Sd land to be sold, and the third part of the money arising from such sale be equally divided between my Sd Daughter’s children named ?amina Snead & Maryan Glover, and the balance to be equally divided between my sons Joseph ? Davis & Absolom Davis to them and their heirs forever.

Item) I give unto my daughter Missemiah Mitchell after paying one half of all my just debts, ten negros named Milley, Harwood, Lucy, Silley, Weltha child of Milley, Winsor, Cealy, Wiley, Adam, and long James with all their future increase, also my will and desire is that my Sd daughter Missemiah Mitchell shall have two thirds of all my stock of very kind, also two thirds of all my household and kitchen furniture excepting three feather beds of furniture, also two thirds of all my plantation utensils, and two thirds of all my crop of every kind that may be growing or left on the plantation at my decease to her and her heirs forever.

Item) I give to my daughter Maryan Hunt, Eight negros named Judah, Weltha, Anne, Milly, Amy, Sarah, Cealy child of Weltha, Amiricus child of Judah’s with all their future increase to her and her heirs forever.

Item) I give unto my Grandson William Hunt after paying one half of my just debts, three negros named Old Cealy, Deamon, & Moll with all their future increase, my Will and desire is that the negro named Moll shall wait on take care of Old Cealy during her natural life, also my Will and desire is that my grandson William Hurt, should have one third part of all my stock of every kind, one third part of all my household & kitchen furniture excepting three feather beds of furniture, one third part of all my plantation utinsels, and one third part of all my crop, that may be growing or left on the plantation at my decease, to him and his heirs forever.

Item) I give unto my granddaughter ?amina Snead one negro who is named Jane with all her future increase, to her and her heirs forever.

Item) I give unto my granddaughter Maryan Glover three negros named Rachel, Anne, and Harrod, with all their future increase to her and her heirs forever.

Item) I give unto my grandson William Hurt one feather bed and furniture before excepted to him and his heirs forever.

Item) I give unto my granddaughter Elizabeth Hurt one negro girl named Isbel with all her future increase to her and her heirs forever.

Item) I give unto my granddaughter Jane Hunt one negro girl named Nancy, child of Judah’s with all her future increase to her and her heirs forever.

Item) I give unto my grandson Solomon Hunt on his arrival of age or married, two negros named Frank and Sealthy with all their future increase, and in case my grandson Solomon Hunt should die before he arrives of age or marries, my Will and desire is that the two negros above named left him with all their future increase, be equally divided between my Sd grandson’s brothers named William Hunt, Absolom Hunt, & Samuel Hunt to him or them and their heirs forever.

Item) I give unto my grandson Absolom Hunt on his arrival of age or married four negros named Roda, John, Mary & Benjamin with all their increase, but in case my grandson Absolom Hunt should die before he arrives of age or marries, my will and desire is that the four negros above named left him with all their future issue increase be equally divided between my Sd grandson’s brothers named William Hunt, Solomon Hunt, & Samuel Hunt to him or them and their heirs forever.

Item) I give unto my grandson Samuel Hunt one negro girl named Keziah, with all her future increase, but in case my grandson Samuel Hunt should die before he arrives of age or marries, my will and desire is that the negro girl named Keziah with all her future increase be equally divided between my Sd grandson’s brothers named William Hunt, Solomon Hunt, & Absolom Hunt to him or them and their heirs forever.

Item) It is my will and desire that the negros left my three grandsons named Solomon Hunt, Absolom Hunt, & Samuel Hunt remain in the hands of James Hunt their father until my Sd grandsons arrive of lawfull age or marries.

Item) I give unto my grandson Absolom Hunt one feather bed and furniture before excepted to him and his heirs forever.

Item) I give unto my great granddaughter Elizabeth Snead one feather bed and furniture excepted to her and her heirs forever.

Item) I give unto my daughter Maryan Hunt one other negro named America to her heirs and her assigns. It is my desire that the negro America should go to my daughter Missemiah Mitchell shoe making and serve all my children as a Doctor for them and their family’s.

Item) Lastly I appoint my son-in-law James Hunt, Maj. Wm Hunt, & Eden Taylor executors to this my last will and testament, hearby revoking all other wills heartofore made in witness whereof I have hearunto set my hand and affixed my seal this twentieth day of February one thousand seven hundred and ninety eight, signed, sealed and acknowledged to be the last will and testament of Sd. Solomon Davis.

Feb 6th 1834 – We the undersigned ?? in conformity to the order of Court of Feb term provided to divide the est. of Jon. Davis Dec. stated to May the daughter of Sd dec. one seventh part of the negros cattle sheet nags they have held and return furniture and implements, ? to the last will and testament of Sd. Dec. which devises as follows. ? one negro woman named Nelly and boy named Richard valued at $675 – and one horse – seven sheep four cattle and four higs. And one seventh of ? and ? and kitchen furniture and implements, which report we respectfully submit. ? our hands the day and date above.

Agreeable to the order of County of Granville NC (Nov term 1839( We the undersigned ? appointed by said court have allocated to Sarah L Davis the following negros – Big Henry, Minerva, Calvin & Bob and to Jas. M. Davis John, Lucinda, Willis, & Harriett after a valuation of the negros by the cowna? There was forty dollars to be paid by Ja. W. Davis ten dollars of which was due to Sarah L Davis and the remaining thirty to the undivided property Jonathan Davis Dec the amount due each was fourteen hundred and ten dollars; the said James last ? to fourteen hundred & fifty dols while that of Sarah ? ? to fourteen hundred dols NC ? to the will of Jno Davis Dec the allotted ? ? of the ? ?, which ? to each legatee four sheep five hogs & two head of cattle in test? Of all of which we have hereunto affixed our names.

Ordered that James Lewis & Howell L Read and William B Glover be appointed commissioners to divide and allot to Robt Mabin and wife his proportion of the estate of Jonathan Davis decd according to the directions set forth in said Davis will & that they report to the next court.

By order of court Feb Term 1836 we the commissioners respectfully report that we have alotted to Robert Mabin and wife (agreeable to the will of Jonathan David Decd) Nelson, Matilda, and Charity as their portion of the negros and likewise their interest in the ? and household and kitchen furniture.
