John Ballard to Joseph Pardue

6 January 1767 - 200 acres

This Indenture made the twenty six Day Of Jenery in the year of our Lord one thousand seven hundred and sixty seven between John Balard of one Part & Jo∫eth Perdue of the other.

Witne∫seth that sd ballard for & in a Consideration of the sum of Sixty five Pound ten Shillings virginea money to him in hand paid the Sealing & Delivering the recip Whereof the sd ballard Doth acknowledge & a quit the sd perdue his Exrs & haith bargained Sold In fee affsd & Confirmed unto the sd perdue a sertain Tract or Parsill of land lying & being in Bute County & laying on the Governor’s line abounded as follows

beginning on yallowood branch so Turning up the sd branch the Various Course to a markt sweet gum then along by a Decideing line to Will’m Huchings former line now John Perdue line thereby that line to a hickory in governer Johnson’s Line thenc the Courses of That line to a markt white oak thenc down by a markt Line to yallowood Branch to thhe beginning in a hickory being two hundred Acres by Estamation being the same more or Le∫s beng part of a tract of Land Granted to Robart Callar baring Date the first Day of July in 1758 & from him to Peter Kimbell by a Deed with the Reversion & Reversions, Remainder & Remainders Rents Ishues and profits thereunto belonging to have & to hold the sd tract of Land with the Appurtenances to the sd Perdue his heirs Executrs & Admitrs or a∫signs forever & the sd Ballard for himself his heirs Exrs & Doth Covenant provi∫e & agree to & with the sd Perdue his heirs in that the premi∫e∫s afsd are free & Clear of all manner of Incumbrance & that the sd perdue may Ever have hold use Ocupy po∫se∫s & Injoy the ∫ame from the sd Ballard his heirs or any other person

William Graves and his wife Mary Graves to John Pardue-1761

 

Deed dated 24 September 1761 - 386 acres from William Graves and his wife Mary Graves to John Pardue on Owen's Creek in Granville County, NC; subsequently in Bute County, NC and finally in Warren County, NC.  Transcribed and submitted by Jonathan DeMai

 

This Indenture made the twenty fourth day of September in the year of our Lord Christ one thousand Seven hundred & Sixty one between William Graves and Mary his wife of Granville County in the Province of North Carolina of the one part and John Pardue late of the County of Amelia in the Colony of Virginia of the other part.

Witneòseth that they the said William Graves and Mary his wife for and in Consideration of the Sum of one hundred and seventy pounds Current money of Virginia to them in hand paid by the said John Pardue at and before the Entering and delivery of these presents the Receipt whereof they the said William Graves and Mary his wife doth hereby Acknowledge and themselves therewith fully Satisfied hath given granted bargained Sold alieued Released and Confirmed and by these presents doth give grant bargain sell alieu Release and Confirm unto the said John Pardue one Certain Tract or parcel of land Situate lying and being in Granville County aforesaid and on both sides Owens Creek Containing by Estimation three hundred and Eighty Six acres be the same more or leòs and bounded as followeth

To Wit. Beginning at Hackney’s Corner a Red Oak in Governor Johnsons line then Runing by the governors line South forty five degrees East Ninety poles to a hickory thence East one hundred and Ninety four pole by Ballards line to a black jack thence North two hundred and fifty Six pole by Kimbals line to a poplar on Owen’s Creek Thence West two hundred and fifty Seven pole Croòsing the said Creek to a white Oak in Hackney’s line thence by his line to the beginning with all woods and or woods ? ways water Course profits Commodities and hereditaments whatsoever to the same belonging or in any wise appertaining thereto Together with the Reversion and Reversions Remainder and Remainders Rents and Iòsues and all the Estate Right Title interest Claim and demand whatsoever of them the said William Graves and Mary his wife hath or ought to have thereto

To have and to hold the aforesaid granted and bargained promiòes unto the said John Pardue his heirs and aòsigns forever for the only proper use benefit and sake of of him the said John Pardue his heirs and aòsigns forever and he the said William Graves and Mary his wife doth Covenant and grant to and with him the said John Pardue that he the said John Pardue his heirs and aòsigns may forever hereafter peaceably and quietly have hold iccupy poòseòs and Enjoy the aforesaid granted and bargained promiòes without the disturbance Molestation or eviction of them the said William Graves and Mary his wife their heirs & forever and they the said William Graves and Mary his wife doth by these presents warrant and defend the aforesaid granted and bargained promiòes unto the said John Pardue free and Clear from all incumbrances of what Nature or kind soever and from the just Claim of any person or persons whatsoever

This Indenture made the twenty Eighth day of February in year of our Lord one thousand seven hundred and sixty seven Between William Kimbell of Bute County in the Provinc of North Carolina of the one Part and Adams Perdue of the Other Part

Witne∫sith that the sd William Kimbell for and In Consideration of the sum of Sixty Pounds Virginia money to him in hand Paid before the Sealing and Delivery of these Pressent to the Receipt whereof the sd William Kimbell doth Acknowledge and himself fully satisfied hath granted Bargained sold and All and Released and Confirmed unto the said Adams Perdue one sertain tract or Parsell of Land Situate Lying and being in Bute County on fortins Branch

Viz: beginning at a red Oak and hicory in Eatons Line thence East by his Line 152 Pole to a black Oak in Hawkins Line thence No 151 Pole by Hawkins to a white Oak Sapling: thence West 102 Pole to a black Oak in Allens Line thence South by his Line and Jones Line 105 Pole to a hicory thence West 65 Pole to fortons Banch thince up the branch to the beginning Containing by Estimation one hundred acres be the same more or Le∫s being Part of a tract of Land which John Howard Purchasd of Capt. John Hawkins and sold the sd Kimbell with Reversion and Reversions Remainders and Remainders Rents I∫hues thereof and all the Estate, Right, title, Interests, Claim and  and Demands whatsoever with all Woods, underwoods, trees, ways, water Courses profits Commodetys hereditaments whatsoever to the same belonging or in any wise appertaining thereto; to the sd Kimbell hath or ought to have hereto; to have and to hold the sd granted and bargaind Premi∫e∫s unto the sd Perdue his heirs and A∫signs forever and he the sd William Kimbell Doth Covenant and Grant to and with the sd Adams Perdue his heirs and a∫igns may forever hereafter Peaceably and Quietly have hold Accupy Po∫se∫s and Injoy the afsd granted and Bargaind Premi∫e∫s without the Disturbance or Molestation or Evictions of him the sd William Kimbell by these Presents warrant & Defend the afsd granted and Bargaind Premi∫e∫s unto the sd Adams Perdue free and Clear from all Incumbrance of what nature or kind soever and from the Just Claim of any Person or Persons whatsoever

Deed from Benjamin Lindsay to Adams Pardue - 1771

This Indenture made this fourth day of March in the year of our Lord One thousand Seven Hundred and Seventy One Between Benjamin Lind∫ay of the one Part of the one part and Adams Pardue of the other part

Witne∫seth that the sd Benjamin Lindsay for and in Consideration of the sum of thirty five Pounds Virginia Money to him in hand Paid on or before the sealing and delivering hereof the Receipt whereof is hereby acknowledged and the said Benjamin Lindsay to the said Adams Pardue doth hereby acquit Discharge hath granted bargained sold and released confirmed and by these Presents do fully and absolutely grant bargain sell and release and confirm unto the said Adams Pardue his heirs and a∫igns forever a certain Tract or parcel of Land Lying and being in the County of Bute on the South Side of Sandy Creek Containing two hundred acres be the same more or le∫s, Beginning at a red Oak on the south side of the creek at the mouth of a branch called wateres Branch thence up the said branch to a white oak, only excepting one acre of Land at the mill on the said branch thence along a line of mark trees to a white oak thence along a line of mark trees to a pine thence along a ling of mark trees to a red oak thence along a line of mark trees to a Spanish Oak on the South Side of the said Creek thence up the said Creek to the First Station the natural water course of the aforesaid Creek is forever to the Bounds Together with all houses buildings thereon and all his right title and Interest in and on the said Premises the Revertion and Revertion Remainder and Remainders rents Issues and profits thereof and every Part and Parcell thereof with the appurtenances To have and To hold the said tract of Land with all edifices profits Privileges his heirs and a∫signs forever he or they Paying Quitrents for the same from the date hereof and the Benjamin Lindsay for himself his heirs Executors and Administrators doth covenant promise and agree to and with the said Adams Pardue his heirs and a∫signs that if above granted Premi∫ses are free and clear of all charges and Incumbrances whatsoever that the said Benjamin Lindsay his heirs hath an Indefeasable of Inheritance infer Simple in and to the said Premi∫ses and Hath full power and authority to dispense of the same and he the said Benjamin Lindsay his heirs Executors and Administrators shall and will warrant and Secure and forever Defend the same to the said Adams Pardue his heirs and a∫signs forever against the Lawfull Claim or demand of any Person or Persons whatsoever and shall and will at any time hereafter on the Reasonable Request of the said Adams Pardue make and Execute such conveyances in the Law as shall be for the Better Confirming or sure making the said Premises to the sd Adams Pardue his  heirs or a∫signs as shall be advised or required  In Witne∫s whereof the said Benjamin Lindsay hathe hereunto set is hand and seal the year and day above written

This Indenture made on this Twentyeth day of Decembr In the year of our Christ One thousand seven Hundred and Seventy three.

 Between James Burk and Sarah Burk his wife of the one part and Allan Love & Co. of ther part.

Witne∫seth that for and in Consideration of the sum of one hundred & one pounds Currt money of Virginia being the Debt. Contracted before the Marriage of James Burk & Sarah Burk by Sarah Burk on and of the Estate of Jno Pardue Decd. Which they the said said James Burk & Sarah Burk are Justly Indebted to the said Allan Love & Co. and honestly desire to Secure and pay to them; and for and in farther Consideration of the sum of the sum of Five shillings the like money to the said James Burk & Sarah Burk in hand paid by the said Allan Love & Co. at and before the Sealing and Delivery of this, the Receipt, whereof they do hereby acknowledge and thereof and of every part thereof do Exonerate and Discharge the said Allan Love & Co. their heirs Executors and Administrators, the said James Burk & Sarah Burk Have Granted Bargained Sold and Confirmd and by these presents do grant Bargain Sell and Confirm to the said Allan Love & Co. their Heirs and a∫signs forever one Certain Tract or parcel of Land in the County of Bute lying on both sides of Owen’s Creek, Containing by Estimateion three hundred & Eighty Six acres be the same more or le∫s & Bounded as followeth to Wit)

 Beginning at Hackeny’s corner a red oak in Governor Johnson’s Line then running by the Governor’s line South forty five degrees East Ninety pole to a Hickory thence East one hundred & ninety four pole by Ballards line to a black Jack thence No. Two hundred and sixty six poles to Kimballs Line to a poplar on owen’s Creek thence west two hundred fifty seven poles cro∫sing the said Creek to a white oak in Hackney’s Line thence by his Line to the Beginning with all the appurtenances Belonging or in any wise appertaining to the premises hereby Granted or Infolded to be Granted and the Rever∫ion and Reversions Remainder and Remainders and all services Benefits of the said Land and premises all their Rights, Claims, Interest and Security Relating to the same; To have and to hold the said Land and other premises unto the said Allan Love & Co. their heirs and a∫signs forever, to the only proper Use and Behoof of them the said Allan Love & Co. their heirs and a∫signs forever and the said James Burk & Sarah Burk do hereby grant for themselves and their heirs that they the said James Burk and Sarah Burk and their heirs and Every of them shall and will Warrant and forever Defend the said land and other premises and Every part and Articles thereof with all and Singular their Right and appurtenances unto the said Allan Love & Co. their heirs and a∫signs for ever against them the said James Burk & Sarah Burk and their Heirs and Every of them and against Every other per∫on whomsoever; Upon Trust, Neverthele∫s that the said Allan Love & Co.; their heirs Executors Administrators or a∫signs shall, after the first day of March in the year of Christ one thousand Seven hundred and Seventy four as soon as the said Allan Love & Co. their heirs Executors, Administrators or a∫signs shall think proper or the said James Burk & Sarah Burk shall Request (which ever of these two Circumstances shall first happen) Sell for the best price that can be gotten after giving Ten days publick notice the said Land and Premises and out of the Money arising from such Sale Discharge pay and Satisfy to Allan Love & Co. their Heirs & the above mentioned sum of one hundred & one pounds like money with lawfull Interest from the day  of one thousand seven hundred and  untill the same shall be fully Discharged and the Expense attending the Drawing and Recording this Indenture and the said Allan Love & Co. their Heirs Executors Administrators or a∫signs forever shall pay or cause to be paid the Overplu∫s of any Remain from such sale to James Burk & Sarah Burk their heirs Executors Administrators or a∫signs or to their order  In Witne∫s whereof the said James Burk &Sarah Burk have hereunto set their hands and seals on the day and year first above written

This Indenture made this fifteenth day of August one Thousand Seven Hundred & Seventy Between Adam Purdue of Bute County in the Province of North Carolina of the one Part & John Davis of the same County & province of the other Part Witne∫seth that the sd Adam Purdue for and inconsideration of the sum of Sixty five Pounds Currant money of Virginia to him in hand Paid before the sealing & Delivery hereof the Receipt hereof the sd Adams Purdue doth Acknowledge and himself therewith fully Sattisfyd hath granted bargined, sold, madeover and confirmed unto the sd John Davis his heirs & A∫siggns one certain tract or Parcell of Land Situate Lying and being in the County of Bute & Province afsd and on forkins Branch

 Beginning at a red Oak & Hickory in Eaton’s line, thence East by his Line 152 pole to a black Oak to Hawkins Line thence W 151 pole by Hawkins line to a white Oak Saplin thence west 102 pole to a black oak in Allens line, thence south by his line & Jones line 105 pole to a hickory thence west 65 pole to Forkins branch thence up the branch to the first Station Containing one hundred acres be the same more or Le∫s being Part being part of a tract of Land John Howard Purchasd of John Hawkins and sold to Wm Kimball of the sd Kimball sold & made over the same to the above sd Purdue with the Reversions and Reversions Remainder & Remainders Rents, Ishues & Profits thereof and all the estate right and title in trust & claim Whatsoever with all woods underwoods & houses and buildings thereon or in any wise appertaining thereto to the sd John Davis his heirs & A∫signs forever

Fields Pardue to William Hogwood

15 February 1770 - 100 acres

This Indenture Made this fifteenth day of February in the yeare of our Lord Christ one thousand Seven hundred & Seventy Between Feals Predue of Bute County in the Province of North Carolina of the one part and William Hogood of the County other part of the other.  Witne∫seth that the said Feals Predue for and in consideration of the sum of Thirty Seven pound ten Shillings to him in hand Paid by the said William Hogwood and by the Receipt Whereof the said Feals Predue doth hereby acknowledge and himself fully and Intirely Satisfied hath granted, bargained and sold A lian Empowd Release Confirmed and by these Presants doth granted bargen and sell a lian Empowerd Leased and Confearm unto the sd William Hogwood his heirs and A∫signs all that an those Devidend tract or parcell of Land Lying and being in the County of Bute Conttaining by Estimation one hundred Acres more or Le∫s

To wit, Beginning at a hickory in Johnathan Johnson’s line thence Runing South to a red Oake thence East to a white Oake in John Jackson’s Line, thence thence along the sd Jacksons to a popler; thence along thence along Johnson line to the beginning Containing by Estimation one hundred acres more or Le∫s and also all profets, Comodites Advanatages hereditaments ways waters and Appurtenances to the above sd Land and premices belonging or any ways appertaining, Reversion and Reversions, Remainder Remainders, rents I∫sues and profits thereof and of Every Part and parcel thereof and all the Estate Right title clame and Demand Whatsoever of him the sd Feals Perdue of in and to the Land and Premeses and Every Part and Parcell thereof

To have and to hold the sd Land aforesd. Land and Premises with the Appurtenances unto the said William Hogood his heirs and a∫signs forever and the sd Feals Predue for him and his heirs the said Land and premises & Every part and parcel thereof Doth hereby agree to warrant and forever Defend against him the said Feals Predue and his heirs to the sd William Hagood his heirs and a∫signs forever.

This Indenture made Ninethanth day of January in the year of our Lord Christ one thousand seven hundred and sixty Eight Between John Pardue of Bute County in the Province of North Carolina of the one Part and Field Pardue in the county aforesaid of the other Part Witne∫seth that the said John Pardue hath given & Delivered with the said Field Pardue of the said County a Certain tract or Parsel of Land Situate Lying in the County aforesaid and Runing the Foloing Courses to wit

Beginning at a hickory in Jonathan Johnsons Line thence South to a read Oak thence East to a white Oak in John Jackson’s Line thence along that Line to a Popler thence along sd Johnson’s Line to the Beginning Containing by estimation one hundred Acres be the same more or Le∫s with the Reversion & Reversions, Remainder & Remainders, Rents, I∫hues & Profits thereunto belonging

To have and to hold the said tract of Land with the Appurtenances to the said Field Pardue his heirs Executors & Administrators or A∫signs forever and the said John Pardue for himself his heirs Exetrs &c doth Covenant and Promise and agree to and with the said Field Perdue his heirs &c that the Premises aforesaid are free & clear of all manner of incuberance and that the said Field Perdue may ever have hold use Ocupy Pose∫s and Injoy the same from the said John Perdue his heirs or any other Person
