Will William Hicks Sr. dating from 14 June 1851 and proven in court in August 1854.

In the name of God amen, I William Hicks Sr of the County of Warren & State of North Carolina being of sound mind and disposing memory and wishing to dispose of my worldly Goods – do make and ordain this my last Will and Testament in the following manner –

First – I give and bequeath all my land to my children, David Hicks, John Hicks, Sarah T. Davis, Nancy Shearin wife of Joseph H. Shearin and Susan A. Hicks wife of Benjamin Thompson, to be equally divided between them according to Valuation –

It is my will and desire that after the land is laid off into lots that my son David Hicks take choice of lots or my old tract of land which contains about one Hundred and forty one Acres more or less at valuation to him and his heirs forever –

Second I give to my three Grand children Heirs of Lewis Hicks decd. that is, John E. Hicks one Hundred & fifty Dollars, Mary T. Hicks one Hundred & fifty Dollars & Louis D. Hicks one Hundred & fifty Dollars – and it is my will that the above named sums of money be kept at Guardian interest until they arrive at the age of twenty one years old – and as they become of age to receive the Above sums with the Interest, the Interest is not to be drawn for any use whatever, but is to remain growing with the principal until they arrive each at age – –

Third, – It is my will that my friend Anderson F. Brame In whom I have all confidence be Guardian for my three above named Grand children –

Fourth – My Will & desire is that after all of my just debts is paid and the money paid to my three Grand children, already mentioned, them all the rest of my property of every denomination be equally divided between my children William Hicks Jr, David Hicks, John Hicks, Sarah T. Davis, Nancy Shearin & Susan A. Hicks wife of Benja Thompson Share & Share alike to them & Their Heirs forever –

Fifth – It is my will that when a division of my property takes place as directed in this my will that my friends in whom I have entire confidence Matthew M. Drake, Anderson F. Brame, Nathan Milam, John E. Twitty & Jno M. Rodwell, or any three of them, value and divide the property as described in this my last Will and Testament –

Lastly – I do hereby constitute and appoint my friend Matthew M. Drake in whom I have all confidence, Executor to this my last Will and Testament.

In Witness whereof I have hereunto set my hand and affixed my seal this 14th day of June in the year of our Lord one thousand eight hundred and fifty one. –

recorded, whereupon M. M. Drake the Exr Therein named qualified as such in due form
by taking the usual oath – for probate see Minutes – Test
