 WILL of EDMOND KEARNEY-1794

 

In the Name of God Amen  This twenty ninth day of June in the Year of our Lord one thousand Seven Hundred & Ninety four-  I Edmond Kearney of the state Northcarolina and County of Warren being at this Time But week of body but of a disposing mind and Memory thanks be to Almighty God for the same-  Calling to Mind that it being Appointed for Man to die and not knowing how soon my Change May come do Ordain this my last Will and Testament first resigning my Soul to him that first Gave it me hoping for Mercy and to be received into the Number of the Blessed above through the Merrits and Intercession of Jesus Christ the Righteous Redeemer and as for my Mortal Body I Desire may be Commited to the Earth and buried in a Christian and Decentlike Manner at the Discsresion of my Executors Hereafter Named and As for my Worldly Estate the blessed Lord has been pleased to bestow upon me I Give and Divise in Manner & Form following.

First that all my Just debts be Honourably paid and my Funerall Expenses discharged

            I Lend unto ,y beloved Wife Sarah Kearney all that part of my lands & plantation included Westerdly or above the following Line Beginning at the Mouth of my Spring branch where it Emptys into ready Creek in the Mill pond.  Then running Up the sd branch to the head there of then running a straight Line to the head of the Persimmon Branch then Down the Persimmon branch to my back or out line.  Also my Negro boy Sam during her Natural life.  I Give my said beloved wife my five following Negroes. Easop Sippo Cato Rachel and Lucy and that she dispose of the same as she may think proper so that it be to any of my children or grandchildren.  I Give my said beloved wife the one half of my stock of cattle with a;; the rest of my Stock of Every Kind a;; my household & kitchen furniture. And plantation Utensils which shall be On or belonging to the plantation where I now live.

I Lend unto my beloved Daughter Mary Harris my Negroes to Witt; Juba Serenah Isham Kitty Warren Easter Green and Caswell with their Present and future Increase During her Natural life.  I will that my Daughter Mary Harris at any time before or at her Death alott the aforesaid Negroes & their increase to her Children as she may think proper (except her son Edward Harris and Daughter Sarah Williams who I have & will provide for) such allotment or Gift Made by her the said Mary Harris to her children in that case I Give Such allotted Negroe or Negroes to such Child or Children  & their Heirs.

            I Give unto my beloved Daughter Sarah Alston my Negroes Jack and Hasty with their present and future Increase which Negroes I heretofore possessed my said Daughter with to her and her Heirs.

            I Give unto my beloved Grand Daughter Sarah Williams my Negores Liza Martin and Betty with their Increase to her & her Heirs.

            I Give unto my beloved Grandson Edmond Kearney my Negroe Girl Vicey & her Increase to him & his Heirs.

            I Give unto my beloved son James Kearney all the rest of my Estate be it of What sort Kind Nature or Quality soever and not before Particularly Given away at the time of my decease with that part of my Land lent unto my beloved Wife with the Negroe Sam lent he aforesaid at her decease to him and his Heirs.

            I Nominate and Appoint my beloved son James Kearney and Son in law James Alston to hole and sole Executors of this my last will and Testament Disannulling all will or wills made by me.  In Witness where unto I have set my hand and affix my seal the day & Date before Written.

This Last Will and Testament of Edmond Kearny Dec’d esd proved in Open Court by the Oaths William Johnson and Jamed Johnson and Ordered to be Recorded whereupon James Kearney one of the Executors herein Named Qualified as such and took upon himself the Execution thereof.
