Will of John Porter

Written: 1728

IN THE NAME OF GOD, AMEN. John Porter, of Cape Fair in North Carolina, at present being weak & Ill of body, but of sound mind and memory, doe make and ordain this to be my last Will and Testament in manner and form following:

Imps. I give and bequeath to my son, John Porter, my negro named Jack and my negro boy named Mars, to be delivered him when he shall attain to the age of Twenty one Years, or day of marriage.

Item, I give and bequeath to my daughter, Sarah Porter, my negro girl named Beck, to be delivered her when she shall attain to the age of Eightteen Years or day of marriage; also a likely young negro man, sound of wind and limb, to be procured out of that part of my Estate which is not Already mentioned, to be given & in like manner as aforesaid, to be deliverd unto my Daughter by my Executrix hereafter mentioned.

Item, I further give and bequeath to my daughter all the increase that shall be hereafter born of my negro wench Nan:

I Give, Devise and Bequeath, to my Dear and Loving Wife, Sarah Porter, all the rest and residue of my Estate not before given, to say, all my lands to Dispose and do with as she shall see proper and convenient, and a Title thereof to make to any person or persons that shall buy or purchase any of my lands of and from my said wife, Also, all the rest of my Goods, Chattels, Rights and Properties, in whatever kind, either here or whereever to be found; and further, that all my lawfull Debts be paid, out of that part of my Estate so coming by this my Will to my loving Wife.

Item, My Will is that in case either of said children should die before they attain to the age above mentioned, or be possessed with the legacies before given them, that then the survivor thereof shall have his or her part of the legacy before given to him or her so Dying, and further my will is, that in case both of my sd. children should die before they attain to the age aforesd. or be possessed with the legacies herein given them, that then, & in such case, their parts or portions herein given shall come to my Loving Wife, Who I make my whole and sole Executrix of this my last Will and Testament.

In witness whereof, I have herewith Sett my hand and seal this Eleventh day of October, 1727.
