He married ELIZABETH 1797.

The petition of Elizabeth Smith humbly complaining sheweth unto your Worships that her husband 
Byrn Smith late of Richmond County departed this life sometime in the year of our Lord one thousand 
eight hundred and forty one having first made and published his last will, and which was admitted 
to Probate at April Term of this Worshipful Court last past and that your petitioner at the present 
Term of your Worshipful Court has entered her dissent in Open Court to the last will and testament 
of her deceased husband, and prays your Worships that a Justice of the Peace and three freeholders 
be appointed by this Court to lay off and allot a years provision (including the articles designated 
by Act of Assembly) in the personal effects of her deceased husband according to law. And as in duty
