1.  EDWARD1 MCMILLAN was born Abt. 1781 in Scotland UK, and died 1864 in Pike County, AL.  He married MARGARET.  
She was born 1790 in North Carolina, and died Abt. 1873.

Notes for EDWARD MCMILLAN:
I Edward MacMillian of the County of Pike and State of Alabama being of 
sound mind and memory and tolerable health, but far advanced in years and aware tthat I must die do make and ordain this my last will 
and testament in manner following to wit.
1st . I will that my body be decently buried at the expense of my estate
2nd. I will that my just debts be paid.
3rd. To my dear wife Margaret I will 60 acres of land including my dwelling and out houses-and the following Negroes, Candis a 
Woman, Henry, Beda, Jena, Ester, Hariet and Julia Ann. The above Negroes to go to my children at the death of my said wife, except 
one which my said wife my select and leave to whom she pleases. Also two choice of horses which I may have at my death-all my stock 
of cattle and half the stock of hogs I may have at my death. All household and kitchen furniture.
4th. To my son Daniel I give a Negro boy named Wattey and boy Jessee to him during his  natural life and to the heirs of his body 
after his death
5th. To my son John, I will a Negro boy Dennis and George also the balance of my land after my wife takes her 60 acres out, also 
my gin and mill and all their fixings to be between Daniel and John
6th. To my Grandson Fenlay McMillian I will that my son John give him $50 as his portion.
7th to my daughter Catharine I have already given her portion (to wit) Amos and Solomon to herself and to the heirs of her body.
To my daughter Sarah Smith and the heirs of her body I give a certain Negro man named Hamp and Nelly (she already had possession 
of Nelly) I have already settled on the said Sarah and heirs as above.
	And now having full confidence in my beloved wife Margaret and my two sons Daniel and John, I hereby appoint them jointly or either 
of them that may act the other refusing to act as executors of this my last will and testament.
I witness whereof I hereunto set my hand and seal in the presence of Daniel McKinnon, Hector P. Blue and Neil McNeill

Edward McMillian since deceased, signed and executed said instrument in the fall of the year 1857 about the month of November, and 
declared the same to be his last will and testament. This will was probated 28th day November 1864. Estate settled 21st August 11, 1866.

The 1850 Census of Pike County, Alabama shows Edward McMillan, Finlay McMillan, Locklan McKinnon and Hector Blue are next door or 
nearby neighbors. Edward McMillan has 2 sons under 21, and 3 sons over 21 (possibly, referring to sons-in-law) 2 males 18-45?, 1 
over 45; 1 white female under 21, and 2 white females over 21 years.

The Petition of Dan'l A. McMillan respectfully represents unto your Honor, That Edward McMillan, who was an inhabitant of this county 
at the time of his death, departed this life on the…day of …1864 in the County of Pike, leaving a last will and testament duly signed 
and published by him, and  attested by Daniel McKinnon, Hector P. Blue and Neill McNeill, who reside in the county in which your 
petitioner, as he verily believes, is named  as executor hereof which said will is produced herewith….  Propounded for probate records 
in …… 

	Your petitioner further states that the widow of said deceased is Mrs. Margaret McMillan, who resides in this county, and that 
the next of  kin of said deceased are his children (to wit:)

Katherine, wife of Neill Smith, daughter (in Pike County, Ala);

	In consideration of all which your petitioner prays that a day may be set for the hearing of the matter of this petition, that 
subpoenas may be issued to bring in subscribing witnesses to certify on such application, direct that due notice of this application may 
be given to said widow and next of kin of said deceased, that such other  preceedings orders and doings may be had in the premises as may 
be required and proper to secure the dues, probate and record of said will according to law. And as in duty bound. etc. [we will ever pray.]
