This Indenture made this Second day of September in the year of our Lord one thoudand seven hundred and ninety seven, between William Huddleston of the Count of Rutherford and State of North Carolina of the one part; and George Upgrove of the same county and state of the other part, witnesseth, that the said William Huddleston for and in consideration of the sum of eighty pounds cash in hand paid to him by the said George Upgroves the receipt ot ?? of is hereby acknowledged, hath granted bargained sold allinated conveyed and confirmed and by these doth bargain sell convey and confirm unto the said George Upgroves his heirs and assigns forever a certain tract or parcel of land situate lying and being in the above mentioned county and state and bounded as follows on Second Broad River and beginning at a black oak on a ridge on the north side of said river and David Huddlestons original corner before he conveyed it to William Huddleston and from thence running South sixty four west ninety five poles to a white hickory on the river bank, thence South thirty seven east ninety poles to a white walnut in and ? land thence north sixty four east ninety five poles to a black oak on David Huddleston line and from thence on said line to the beginning, it being part of a tract of four hundred acres granted to David Huddleston dated the sixth of April A.D. 1765, containing fifty five acres more or les; with the appurtainances there unto belonging, together with all and singular ?? the priviledges rights hereditaments and possessions anywise belonging thereto unto him the said George Upgroves his heirs and assigns forever, and the said William Huddleston doth by these presents doth warrant and forever defend the same to the only use and behoof of the said George Upgroves from himself his heirs and assigns or from any other person or persons whatsoever, to have and to hold the said land and premises unto the said George Upgroves his heirs and assigns forever in fee simple, and the said William Huddleston doth covenant and agree to and with the said George Upgroves that the signing sealing and delivering of these presents he ?? be lawfully seized of and indefe??ble right of inheretence free from all incumbrance of any person or persons whatsoever; in witness thereto the said William Huddleston hath hereunto interchangeably set his hand and affixed his seal the date first above written.
