No. 943 This Indenture made this first day of April in the year of our Lord one thousand seven hundred and eighty eight Between Samuel McMurry of Rutherford County and State of North Carolina of the one part; and Thomas McMurry of the same county and state aforesaid of the other part. Witnesseth that the said Samuel McMurry for and in consideration of the sum of thirty pounds to him in hand paid by the said Thomas McMurry the receipt where of is hereby acknowledged hath bargained sold affiened released conveyed and confirmed and by these presents doth bargain sell alien releas convey and confirm all that tract piece & parcel of land situate lying and being in Rutherford County and State aforesaid on the Waters of Catheys Creek, the waters of Second Broad river including Walkers camping place, Beginning at a black oak near Joseph Blacks corner thence North five East one hundred and fifty poles to a white oak, thence North Eighty five West two hundred and fifty poles with Hugh Blacks line to a hickory saplin thence South five West one hundred and sixteen poles to a post oak thence with Joseph Blacks line to the Beginning; the whole containing two hundred acres the same being granted by patent to James Black bearing date April the 9th day 1770 then by deed of conveyance from James Black to Samuel McMurry bearing date October the 24, 1772 as appears of record more fully with the appurtainances thereunto belonging or appertaining unto the said lands and premises unto the said Thomas McMurry and his heirs and assigns forever, and the said Samuel McMurry doth by these presents warrant and defend the said land and premises from himself his heirs executors administrators and assigns and all persons whatsoever claiming the same unto the said Thomas McMurry his heirs executors administrators and assigns in fee simple forever to have and to hold the said land and premises unto the said Thomas McMurry according to the true intent and meaning of these presents. In witness whereof the said Samuel McMurry hath hereunto set his hand and affixed his seal the day and year first above written.
