August the 1st 1816 No. 28
This Indenture made this 19th day of Aug’t in the
year of our Lord 1815 between Wm McMary of the
County of Rutherford & state of North Carolina of
the one part & Martin S. Elliott of the County and
State aforesaid of the other part, witnesseth that
the said Wm McMory for and in consideration of the
sum of three hundred pounds lawfull money of the
State aforesaid in hand paid before the sealing &
delivering of these presents the rec’t and paynment
whereof the said Wm McMory hereby acknowledges he
the said Wm McMory hath bargained and sold alined
and confirmed & doth by these presents bargain sell
alien convey enf?? & confirm unto the said Martin S.
Elliott his heirs and assigns forever all my part of
land left to me by my Fathers will 225 acres more or
less it being the same where the said Wm McMory now
lives and also the revision & revisions and
remainder and remainders to have and to hold to the
said Martin S. Elliott with all and singular the
rights and ervises of the above mentioned premises
and every part thereof and all the estate right
title Claim interest and demand whatsoever of him
the said Wm McMory his heirs and assigns of … and to
the said tract of land and premises above mentioned
to him the said Martin S. Elliott his heirs and
assigns forever & the said Wm McMery & his heirs the
said tract or parcel of land with all and singular
the said premises above mentined against himself &
his heirs and against all and every other person or
persons whatsoever will warrant and forever defend
to the said Martin S. Elliott his heirs and assigns
forever in quiet and peaceable possession in witness
whereof the said Wm McMory hath hereunto set his
hand and affixed his seal the day and year first
above written signed sealed & delivered in presents
of us
