Deed of Gift

 
To all whom it may concern
Be it known that in consequence of the Intermarriage of WALTER R. LENOIR of Wilkes County and State of North Caroline with MARY ELVIRA BOUCHELL daughter of DOCTOR THOMAS BOUCHELL of Burke County and State aforesaid. The said THOS BOUCHELL do allot, set apart, give and deliver to the said MARY ELVIRA, A Negro woman named CATE about thirty years old, a Negro woman named SHELAN about sixteen years old & a Negro girl named NANCY about ten years old. And the said CATE since she delivered into the possession of the said WALTER R. LENOIR and MARY ELVIRA his wife, hath had two sons born viz, JACKSON and HAMPTON. And where as the said MARY ELVIRA LENOIR is now dead, we the said THOMAS BOUCHELL and WALTER R. LENOIR, hath mutually agreed to give the above mentioned five Negroes to the two Infant children of the said WALTER R. LENOIR and MARY ELVIRA LENOIR his wife, viz, ELVIRA CLARISA EVELINA LENOIR and WILLIAM BOUCHELL LENOIR, to be equally divided between them. And in consequence of the natural love and affection which we have and do bear to and for the two Infants above mentioned, we do hereby give, convey and deliver the aforesaid five Negroes and their Increase to the aforeaid ELVIRA CLARISA EVELINA LENOIR and WILLIAM BOUCHELL LENOIR to be equally divided between them when either of them arrives to lawfull age or marries in the following conditions & provisoes. If either of the aforesaid Infants should die before she or her arrives to lawfull age leaving no lawfull issue the aforesaid Negroes are to descend to the survivors of them. The aforesaid Negroes to remain in the possession and under the care of said WALTER R. LENOIR until one of the aforesaid two Infants arrives to lawfull age or marries if he the said WALTER should live till that time, but he should die before either of the aforesaid Infants arrives to lawfull age or marries, then the said Negroes and their Increase to be delivered to some suitable person appointed as a guardian for the aforesaid two Infant children to be by him held and kept for the sole use and benefit of said Infants or the survivor of them as aforesaid. Provided nevertheless that he the said WALTER R. LENOIR, is hereby authorised and impowered to sell, barter or exchange the aforesaid Negro woman SHELAN at his own discretion, for money, a Negro, or other property and to apply the proceeds of said sale, barter or exchange, to the sole use and benefit of the aforesaid two Infants, or the survivor of them in the same manner that the said Negro SHELAN is hereby given and intended to be applyed if not sold bartered nor exchanged as above mentioned. In testimony we hereunto set our hands and seals this eighth day of January 1818.
