Notes for JAMES MCMILLAN: According to the Old Parish Records he was initially stated as a weaver during John's Christening. When his second child was born he is recorded as being a Wax chandler Maker. There are two possibilities for the birth of James McMillan. There was a James McMillan was born on May 2, 1736 in Inverness to James McMillan and Catherine Baird. There was a James McMillan was born on June 16, 1737 in St. Cuthberts to a Thomas McMillan and a Barbara Frazer. Notes for JOHN MCMILLAN: John McMillan was selected the first Clerk of the Court of the newly formed Ashe County. The first deed registered in Book 1, October 3, 1799 bore his signature. John McMillan was a well educated Scotsman who was adventurous and came to America with his sweetheart Marion McLymont. She wishing to see her family one last time, took a candle and looked at each member before leaving on the ship to sail that night. Their tombstones now standing in Allegheny County near the copper mines read: "In Memory of John McMillan born in Scotland, November 13, 1756 Died February 23rd 1844 in the 88th year of his age." At his side "In Memory of Marion wife of John McMillan born in Scotland, Died April 15, 1839 aged 76 years." Near the town of Stratford. John was an extensive landowner by grant and purchase. His first land grant was dated November 28, 1801. Fifth generation McMillan's still live on part of this land grant property. Their children mentioned in the will were; Peggy m. James Maxwell; Mary m. Willam Andrew Fields; James m. Thursey Gambill; Andrew m. Jennie Fields; John m. Narcissa Gambill; Nancy m. Capt. Joseph Phipps; Alexander B. m. Mary (Pollie) Reeves. May be from Dundee, Scotland. Also have a reference to a John McMillan Christened 20 November 1755 in Campbeltown, Argyll, Sct., son of John McMillan and Ann McConochy. Marion Crawford November 19, 1792 - Edinburgh Andrew b. 31st May 1776 at Edinburgh (Ref. 685.1/35 Fr. 9274) Theodore b. 11th March 1778 at Edinburgh (Ref. 685.1/36 Fr. 9421) According to Carole Wilson, from the Scottish Family Search, she states the following: If James and Jean have used the traditional naming patterns they would have named their first son after his paternal grandfather and their second son after the maternal grandfather. The first daughter would have been named after her maternal grandmother and the second daughter after paternal grandmother. This would mean James' parents would have been called John and Elizabeth and Jean's parents would of been William and Margaret. However, the marriage entry states that Jean's father was James Douglas. So she was not confident the couple have followed this tradition. It is noted in several reference materials that John and Marion were on board ship for a year before arriving in NC. When they arrived in NC they settled in what was initially Wilkes County with a land grant for several hundreds of acres of land reaching from Elk Creek to the waters of Potato Creek. Name also spelled as McLeamont or LaMont. Also found info saying buried near Stratford, Allegheny County, NC near the residence of Wiley McMillan. Marion and John decided to elope because Marion's older sister was unmarried in 1787. Under Scottish Law or Tradition of the time a younger sister could not marry if the older sister was unmarried. Marion's older sister did not have even a suitor. Marion's parents were also against her marrying John McMillan, because he was leaving for America. This is also said to be the reason for them eloping. Marriage Notes for JOHN MCMILLAN and MARION MCLEAMONT: John McMillan was in love with a lady named Marion McLeamont (some spellings show LaMont). She was the second oldest sister in a large family. Scottish law, at the time, required the oldest sister to marry first. Since her older sister had not taken a courtier, John decided to elope with Marion to the Americas. They married aboard ship on the way to America. They moved to Ashe County, NC. In addtion hereto I give her two choice cows, six choice hogs and two sheep andd fifty dollars in money. McMillan Eveline Young, Polly Chambers, Marion Young, Peggy Senter heirs to be equally divided among themor their heirs. as the Nergoe property that I give ny daughters in palce of land that I give to my sons has been lost I give them 400 and twleve acres of land known as the Turner and Nettle cove lands to be equally divided between them or their heirs. There is seventy acres of land known as the Copper Mine tract that is to be sold with all balance of my property and the money divided equally with all my heirs also all money on hand at my death and notes to be equally divided among all my heirs after they are collected. All notes that I hold against anu of my children is to be accounted for both principle and interest. Baldwin house place and south of Joseph B. I give my two horses Doll and Dove, all my household and kitchen furniture and I give my wife three Negroes her choice during her life. I give to William McMillan my negro boy Simon and to my son John McMillan I give the negro boy Samm and to my daughter Adaline I give the negro boy Alfred, to my daughter Polly Dickson I give her a note I hold om Emoch Reeves that he gave me for teh negro girl I sold him. My daughter Nancy that married Nash (Noah) Baldwin being dead and left no heirs and what property that I gave him after said marriage he may keep, but he is not to have anymore of my estate and the note I hold on Nash (Noah) Baldwin he is to pay it to my estate or heirs. To my daughter Jane I give a small negroe girl named Ann (Alice). The balance of my property not willed is to be sold and all my debts collected and all my debts to be paid. And any money remaining on hand to be divided among my daughters so as to make them equal, except Cindy Cavender, the propety that I gave my two sons is to be all that they are to have the land that I purchased in Grayson County known as the Ed Parsons tract Caswell Halsey is to have. The land on the west side of the wagon road at its value, if he can pay for all said tract he may have it. If not the residence is to be sold and the money divided among my daughters as above mentioned with theabove exceptions. I give to my daughter Jane a mare she claims to be her property. McMillan was the second Captain of Co. A, the Jeff Davis Mountaineers and served in that capacity until a reorganization of the regiment in March 1862. He was defeated for re-election as Captain. He then raised an independent company of cavalry, McMillans' Independent Co., North Carolina Troops. These types of groups had been authorized by the General Assembly for local defense purposes. After complaints from citizens across North Carolina about depredations committed by such troopers, the legislature disbanded them. McMillans' command was then incorporated into the regular Confederate cavalry organization in September 1863. McMillan apparently commanded Co. C of McRae's Battalion North Carolina Cavalry. These Cavalry companies served in the capacity of local police forces rounding up deserters and enforcing the conscription law.
