Will of John Daniell

Brunswick County, North Carolina
In the name of God, amen I, John
Daniel of Brunswick County in the Province of North
Carolina being sick of body but of sound and disposing
mind and memory do make and constitute this to be my
last will and testament in manner and form following
that is to say
First I commend my soul to almighty God who is the
giver of all things hoping for salvation through the
merit of Jesus Christ my blessed redeemer and my body
to the earth to be decently buried at the discretion
of my executors hereafter named and my desire is that
all my just debts be paid and as to what worldly
estate it hath pleased God to bless me with, I give
and dispose of in manner and form following -
Item, first I give and bequeath unto my loving wife
Ann Daniell and to her heirs forever one half of all
my personal estate let the same be of what kind or
nature so ever to be delivered to her clear of all
incumbrances whatsoever and I also give and bequeath
unto my said wife Ann Daniell all my stock of cattle
and plantation whereon I now live to my said wife
during her life if she likes, if not to be sold and
for her to take half of the plantation and all the
stock for my said wife forever and bequeath unto my
loving wife all my house furniture for her and her
heirs forever.
Item, I give and bequeath all rest residue and
remainder of my estate both real and personal to and
amongst my loving brothers Robert Daniell, George
Daniell to be equally divided between them two share
and share alike. I give and bequeath unto my brother
William Daniell the sum of ten pounds procl and
bequeath unto my brother Stephen Bedon Daniell the sum
of five pounds pro. money. And lastly I do hereby make
ordain constitute and appoint my ever loving wife as
an executrix and my true and loving friend Rich'd
Quince Junr Esq to be executor to this my last will
and testament revoking disannulling all former and
other wills by me made and I do acknowledge this and
none other to be my last will and testament. In
witness whereof I have hereunto set my hand and seal
this fifth day of January in the year of our Lord
1771.
Signed sealed published and acknowledged to be my Last
Will & Testament in the presence of us.
This will was proved at June 1771
by the oath of Rich'd Quince Junr & Will'm Lord
who swore to the handwriting.
