North Carolina This indenture made the 12 day of
February in the year of our Lord 1795 between Benjamin Rowell of the
county of Brunswick and State of North Carolina planter of the one part
and Benjamin Smith of Belvidere and county aforesaid of the other part
witnesseth that for and in consideration of the sum of two thousand
pounds to the said Benjamin Rowell in hand paid by the said Benjamin
Smith at or before the sealing or delivery of these presents the
receipt whereof he doth hereby acknowledge he the said Benj Rowell hath
granted bargained sold aliened and confirmed and by these presents doth
grant bargain sell alien and confirm unto the said Benj Smith and his
heirs all that piece or parcel of land situate in Brunswick County
aforesaid being at or near the branch of Juniper Creek on Milliken's
upper line runs thence south to the beginning corner on the Wolf Ridge
of lands patented to the Honorable Patrick Henry Esq formerly Governor
of the State of Virginia and by him said to be sold of the Honorable
Major General Lee late Governor of said state then with his upper line
east 123 chains to his upper back corner then with his back line south
720 chains to a stake then east 240 chains to a stake then north 840
chains to a stake then east 121 chains to a stake then northwardly to a
stake 60 chains to the westward of branch in the North 60 West 200
chains line of his Viz: Benjamin Rowell's patent with said line to
Alligator branch then down the (?) (?) thereof to Thomas Hickman's
upper line then with his upper line in a North East direction to his
corner stake then with his other line to his beginning on Alligator,
then down the meanders thereof to Juniper Creek then down the meanders
thereof to the beginning, exclusive of Benjamin Taylor own claim of
three hundred acres. And also one other piece or parcel of land
beginning at William Collins corner in the Green Swamp where the Beaver
Dam and the Green Swamp joins there northwardly in a direct cause to
Swan's corner then No 25 E 81 chains to Henry Taylor's corner then No 114 Wt 80 chains to a stake on Town Creek Road then
along the road to to General Benjamin Smith's corner of his 200 acre
patent on Bells Swamp then south 78 Wt 50 chains to a stake corner of a
patent of Stephen Williams then Wt along Stephen Williams line
someny(?) chains that is a south cause to the East 700 chains line of
said Patent to Benjamin Rowell and running along his own Collins line
to Collins corner in the Green Swamp above mentioned where the Beaver
Dam & Green Swamp joins and makes up the quantity of twenty five
thousand acres the same being part of a pattent granted to said
Benjamin Rowell on the first day of January 1795. to and in the name of
the said Benjamin Rowell and all houses trees ways waters water causes
profits commodities herediments & appurtenances whatsoever to the
said premises or any part thereof belonging and the reversion and
reversions remander and remandes rents issues and profits thereof and
also all the estate right title interest use trust property claim or
demand whatsoever of him the said Benjamin Rowell of in and to the said
premises to have and to hold the lands hereby conveyed and all and
singular other the premises and every part and parcel thereof with
their and every of their appurtenances unto the said Benjamin Smith his
heirs and assigns forever and the said Benj Rowell doth hereby grant
for himself and his heirrs that he the said Benjamin Rowll and his
heirs the premises hereby granted and every part and parcel thereof
with all and singular their and every of their appurtenances unto the
said Benjamin Smith his heirs and assigns against him the said Benjamin
Rowell his heirs executors administrators or any person claiming from
by or under them or him shall and will warrant and forever defend by
these presents in witness whereof the said Benjamin Rowell hath
hereutno set his name and seal the day and year first above written. Benjamin Rowell (seal) May 17th 1795 the execution of the within deed by the within named Benjamin Rowell to the within mentioned General Smith then proved before me by the oath of William Kelly one of the subscribing witnesses thereto. This indenture made the sixteenth day of
February in the year of our Lord one thousand seven hundred and
ninety-five Between Benjamin Rowell of Livingston Creek in the county
of Brunswick, Planter of the one part and Benjamin Smith of Belvidere
in the same county, Planter of the other part witnesseth that for and
in consideration of the sum of one thousand and nineteen pounds,
ninteen shillings to him in hand paid, the receipt whereof is hereby
acknowledged. He the said Benjamin Rowell hath granted, bargained,
sold, aliened, and confirmed and by these presents doth grant, bargain,
sell, alien and confirm unto the said Benjamin Smith and to his heirs
forever all that tract or parcel of land beginning at (or near) the
mouth of Juniper Creek on Millikins upper line and runs thence south to
the beginning corner on the Wolf Ridge of lands patented to the
Honorable Patrick Henry Esquire formerly Governor of the State of
Virginia and by him (said to be) lately sold to the Honorable Major
General Lee late Governor of the said state, then with his line East
one hundred and twenty-three chains to his upper back corner, thence
with his back line south seven hundred and twenty chains to a stake,
thence east two hundred and forty chains to a stake, then north three
hundred and forty chains to a stake, then east one hundred and twenty
one chains to a stake, then northwardly sixty chains to the westward of
the Mulberry Branch in the north sixty west two hundred chains line of
this (Benjamin Rowells) patent with said line to Alligator Branch, then
down the varioius courses thereof to Thomas Hickman's upper line, then
with his upper line in a northeast direction to his corner stake, then
with his other line to his beginning on Alligator, then down the
meanders thereof to Juniper Creek, then down the meanders of said Creek
to the beginning, exclusive of Benjamin Taylor's settlement and claim
of three hundred acres. And also one other piece or parcel of land
beginning at William Collins' corner in the Green Swamp where the
Beaverdam and the Green Swamp joins, then
northeastwardly in a direct course to Swain's corner, then north twenty
five east eighty one chains to Henry Taylor's corner, then south sixty
six east one hundred and ten chains to a stake, then south eighty
chains to a stake, then east eighty chains to a stake, then north two
hundred and forty chains to a stake, then north forty-six west eighty
chains to a stake on Town Creek Road, then along said road to General
Benjamin Smith's corner of his two hundred acre patent on Bells Swamp,
then south seventy eight west fity chains, then south thirty six west
twenty six chains to a stake, corner of a patent to Stephen Williams,
thence west along Stephen Williams line so many chains as that a fourth
course to the east seven hundred and seventy chains line of said patent
to Benjamin Rowells running along his and Collins' line to Collins'
corner in the Green Swamp above mentioned where the Beaver Dam and
Green Swamp joins will make up the quantity of twenty-five thousand
acres, the same before described parcels being part of a patent to the
said Benjamin Rowell for thirty thousand acres dated at Raleigh the
first day of January One Thousand seven hundred and ninety-five and all
houses, trees, ways, waters, water courses, profits, commodities,
hereditaments and appurtances whatever to the said premesis or any part
thereof belonging and the reversion and reversions remainder and
remaindes, rents, issues, and profits thereof and also all the estate,
right, title, interest, use, trust, property, claim and demand
whatsoever of him the said Benjamin Rowell of in and to the said
premises, to have and to hold the lands hereby conveyed and all and
singular other the premises and every part and parcel thereof with
theirs and every of their appurtenances unto the said Benjamin Smith
his heirs and assigns forever, to the only proper use and behoof of him
the said Benjamin Smith his heirs and assigns forever. And the said
Benjamin Rowell doth hereby grant for himself and his heirs that he the
said Benjamin Rowell and his heirs the
premises hereby granted and every part and parcel thereof with all and
singular their and every of their appurtances unto the said Benjamin
Smith his heirs and assigns against him the said Benjamin Rowell, his
heirs, executors, and administrators or any person claiming from by or
under them or him shall deed, will, warrant, and forever defend by
these presents. In witness whereof the said Benjamin Rowell hath
hereunto set his hand and seal on the day and year first above written.
