I<strong>\u00a0JOHN WHITEHURST\u00a0<\/strong>of the County of Camden &amp; State of North Carolina. Being in a reasonable state of health in body &amp; of perfect sound mind &amp; memory thanks be given unto God for the same. Calling to mind the mortality of my body knowing that it is appointed unto all men once to die, do make and ordain this my Last Will and Testament in the manner following.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item the First. I give &amp; bequeath unto my well beloved Son\u00a0<strong>JOHN WHITE<\/strong>\u00a0one half of my land where I now live where my houses are to him &amp; his heirs forever.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item the Second. I give &amp; bequeath unto my well beloved Son\u00a0<strong>SIMON\u00a0WHITEHURST<\/strong>\u00a0the other half of my land the same to be equally divided between my two Sons\u00a0<strong>JOHN &amp; SIMON WHITEHURST<\/strong>\u00a0and to begin at JOSEPH CHAMBERLAIN\u2019S line &amp; run diametrically across to JOSEPH WHITEHURST\u2019S line, with a free privilege to drain each others land through either parts of said\u00a0<strong>JOHN WHITEHURST\u2019S\u00a0<\/strong>&amp;<strong>\u00a0SIMON\u00a0WHITEHURST\u2019S<\/strong>\u00a0land, and one cow &amp; calf that he claims to him &amp; his heirs forever.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item the Third. I give &amp; bequeath to my well beloved Daughter\u00a0<strong>MARY\u00a0WHITEHURST\u00a0<\/strong>one feather bed &amp; furniture and one cow and calf to her &amp; her heirs forever.<\/span><\/p>\n<p><span style=\"font-size: medium\">Fourthly. I give and bequeath unto my well beloved Daughter\u00a0<strong>SALLY\u00a0WHITEHURST<\/strong>\u00a0one feather bed &amp; furniture and one cow &amp; calf to her &amp; her heirs forever.<\/span><\/p>\n<p><span style=\"font-size: medium\">Lastly. I leave all the remainder of my property to be sold to pay my just debts any should remain after paying my just debts to be equally divided between<strong>\u00a0CHARLES WHITEHURST,\u00a0JANE TAYLOR,\u00a0SALLY BRITE,\u00a0MARY WHITEHURST\u00a0<\/strong>and<strong>\u00a0JACKY WHITEHURST<\/strong>. Furthermore it is my will and desire should either or both of my Sons\u00a0<strong>JOHN WHITEHURST\u00a0<\/strong>or<strong>\u00a0SIMON WHITEHURST\u00a0<\/strong>die without an heir lawfully begotten by their body for my two Daughters\u00a0<strong>MARY\u00a0&amp;\u00a0JACKY WHITEHURST<\/strong>\u00a0to have the said deceased land.<\/span><\/p>\n<p><span style=\"font-size: medium\">I also appoint &amp; constitute my Son\u00a0<strong>CHARLES WHITEHURST<\/strong>\u00a0&amp; my Son in Law\u00a0<strong>JOHN M\u2019ALLEN BRITE<\/strong>\u00a0Executors to this my Last Will and Testament to do according to the legacies bequeathed in witness I have hereunto set my hand &amp; seal this the 10 of July 1822.<\/span><\/p>\n<p><span style=\"font-size: medium\"><strong>JOHN WHITEHURST<\/strong>\u00a0seal<\/span><\/p>\n<p><span style=\"font-size: medium\">His x mark<\/span><\/p>\n<p><span style=\"font-size: medium\">Signed, sealed in the<\/span><\/p>\n<p><span style=\"font-size: medium\">Presence of<\/span><\/p>\n<p><strong><span style=\"font-size: medium\">JOHN M\u2019ALLEN BRITE<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: medium\">FANNY GRIMES<\/span><\/strong><\/p>\n<p><span style=\"font-size: medium\">Her x mark<\/span><\/p>\n<hr \/>\n<p><span style=\"font-size: medium\">Camden County Court<\/span><\/p>\n<p><span style=\"font-size: medium\">November Term 1822<\/span><\/p>\n<p><span style=\"font-size: medium\">This instrument of writing was exhibited in open Court &amp; proved as the Last Will &amp; Testament of\u00a0<strong>JOHN WHITEHURST<\/strong>\u00a0dec\u2019d. by the oath of <strong>IRA McPHERSON<\/strong> a subscribing witness thereto&#8212;&#8211;And at same time <strong>CHARLES WHITEHURST<\/strong> one of the Executors therein named appeared &amp; qualified as an Executor thereto Ordered that Testamentary letters issue, &amp; that the same be Recorded.<\/span><\/p>\n<p><span style=\"font-size: medium\">Test.<\/span><\/p>\n<p><span style=\"font-size: medium\">M.S.
