ORPHAN'S INDENTURES & GUARDIANSHIP RECORDS IN COURT MINUTES
The child could petition the courts for a new master, if he could prove that
the present one was not fulfilling the contract, or was mistreated. And the
master could ask the court to break the contract and a new person be named
guardian, if they could not fulfil the bargain.
An orphan child 'could' (not
all did) ask, for a certain person to be their guardian, IF, they were over
14 years of age, when orphaned. (Remember, "orphaned" did NOT mean
that BOTH parents were dead) Many times, the Mother just could not support
all her children, alone and if she remarried, sometimes the new stepfather
didn't want to, especially once they had been bound out. You will see, in some
cases where, the Mother WAS given custody, as guardian, when she (meaning the
estate of her deceased husband) could support her family.
AND if you find a
document saying that a child was an "orphan" and a guardian was named for them,
but NO indenture, then it is likely that, the child had either Mother or Father,
or both, still living.
The courts were required, to name a guardian in the
instances, of a child inheriting property, from another person. Grandparents,
for instance, who died and left a legacy to a child. To insure that the
inheritance was honestly administered, there had to be an impartial trustee or
guardian.
LASTLY, not all indentured servants WERE orphans. However, I have
extracted ONLY the orphans in this case.

William Jones, dec'd and indentures being done on their children, at the
same time, in spite of the common name.

indenture, it mentions the master, so we know he was an apprentice and Moses'
brother is given.

(I see here that he is said to be only 7 years of age, whereas in
the bastardy citation he is said to be Nine years of age. This certainly gives
his master two more years of servitude, doesn't it? How convenient that they
didn't have an exact date of birth, hmmm.?)

THOMPSON, ELIZABETH THOMPSON, & CHARLES THOMPSON, the heirs of BALAAM
THOMPSON Esqr. , dec'd, to defend a certain suit brought against them by HANNAH
THOMPSON, widow & relict of said BALAAM THOMPSON, for her dower in the lands
of her said dec'd husband.
(John represented the minor children as well as
the other children who were of majority but, not named, in the law suit.) The
court ordered a jury to survey the lands and lay out her widows dower and
distribute the shares.

MILES SCARBROUGH exhibited his accts' against SALLY
BRINKLEY & WILLIAM BRINKLEY, orphans of ROBERT BRINKLEY, dec'd for boarding
and clothing them and a (Nyslon or Nyacon)??? ( it might be Nurse, but it
certainly doesn't look like it,) for the years 1796 and 1797, amounting to 42
pounds, which the court allows & orders to be paid of their estate.
