Monday Nov. 26th 1810 Court met in course

Present Jos. Ferrebee, Andrew Duke, Willis Gallop} Esqrs.

Ordered that Willis Gallop renew his bond as commissioner of wrecks for the ensuing year who entered into bond with Joseph Ferrebee & Andrew Duke Esqrs. in the sum of £2000.

On motion ordered that Andrew Duke, John Doxie, Dory Douge and John Ballance or any 3 of them audit & settle the accounts of Anna Cox adm. of Benj. Cox decd. with sd. estate & make returns.

Ordered that Anna Cox admx. & guardn. to the orphans of Benj. Cox deceased have leave to get some Juniper Timber in a swamp belonging to her wards such as is most liable to waste & decay & that she return a fair account of the proceeds of such lumber got off sd. swamp for her wards.

On motion & by request of Sally Corvan it is ordered that Anthony Simmons be appointed guardn. to Polly S. daughter of Thos. Corvan who gave bond with Saml. Douge & Wm. Brumsey in £300.

Ordered that Henry orphan of Wm. Fountain decd. be bound to Wm. Wroten Senr. untill he arrives to 21 yrs. old being now about 15 to learn the trade of a waterman.

Ordered that Reuben Taylor Sn. be appointed Admr. ad colligendum to collect & receive into his possession all the personal property of Reuben Taylor decd. until the question is determined as to the will of said decd; who entered into bond of £100 with Andrew Duke & James Poyner securities.

Ordered that Sabra Etheridge be appointed guardn. to Richd., Nancy, Harcott, Seth, Wm. B. & Morris orphans of Richd. Etheridge decd., who entered into bond with Enoch Forbes & Jos. Ferrebee in £200 for each orphan.

Ordered that Sarah Hutchins be appointed guardian to Huldah & Polly orphans of Wm. Hutchins decd. who entered into bond with Saml. Dozier & Wm. Brumsey in £200 for each orphan.

Ordered that Director Dunton have the right of admr. on the estate of Daniel Dunton decd. who entered into bond with Col. Andrew Duke & Caleb Etheridge securities in £5000 & qualified.

Ordered that the admr. of Danl. Dunton sell the perishable estate &c.

Court adjourned.

Tuesday Nov. 27th Court met

Ordered that Joseph Taylor orphan of John Taylor decd. be bound apprentice to Lemuel Taylor in lieu of Benj. Taylor decd. late master until he arrive to the age of 21 yrs. being now 13 or 14 to learn the bricklayers trade.

Ordered that Polly Dough be appointed guardian to Damson & James Dough orphans of James [inserted: Aaron] Dough decd. who entered into bond with Enoch Forbes & Solomon[...]

Jury to wit: Wallis Bray 1, John Mackie 2, James Dauge 3, Thos. Gray 4, Luke Hill 5, Jona. Hall 6, Joshua West 7, Jas. Cowell 8, John Church 9, Saml. Whitehurst 10, Saml. Dauge 11, Philip Dauge 12 impannelled & sworn say the defendant did assume.

The last will & testament of Benj. Taylor (Shell bank) decd. was exhibited in open court & proved by the oaths of Saml. Phillips & Leml. Taylor & likewise the annexed codicil proved by the oath of Saml. Salyear Sen. & Mary Taylor exx. therein named qualified thereto.

Ordered that Saml. Philips be appointed overseer of the head of the bay road for the ensuing year in room of Lemuel Sanderson late overseer.

The last will & testament of Wm. Wheatley decd. was exhibited in open Court & proved by the oaths of Davis Fancher & Willo. Wheatley subscribing evidences & at the same time Josiah Etheridge exr. therein named qualified.

Ordered that the exr. of Wm. Wheatley decd. sell &c.

Ordered that David James be appointed overseer of the public road from the Court house to Bells island in room of Joshua Bell.

Ordered that Levin Dunton be appointed guardn. to Edmond & Susannah orphans of Jacob Dunton decd. in room of Danl. Dunton decd. who entered into bond with Dory Douge & Caleb Etheridge in the sum of £500 for each.

Ordered that Wm. orphan of Wm. Lindsey decd. be bound apprentice to Jona. Lindsey untill he arrive to the age of 21 yrs. being now about 15[?] to learn the farmers business.

Ordered that John Lindsey orphan be bound apprentice to Daniel Lindsey untill he arrive to the age of 21 yrs being now about 13 to learn the farmers business.

Ordered that Thos. Tillett Esq., Caleb Toler, Wm. Etheridge (N.B.) & Saml. Tillett or any 3 of them divide the estate of Danl. Beachum decd. equally among his lawful representatives.

Ordered that Moses Bunnell be appointed overseer of the road from Walmseys mill to Peter Morses in room of Wm. Etheridge Jr.

Ordered that Wm. Wilson sen. have the right of admr. on the estaste of James Parsons decd who qualified & entered into bond with Saml. Scott & Thos. Poyner securities in the sum of £100.

Ordered that the admr. of James Parsons sell &c.

Ordered that Thos. Baxter, Andrew Duke, Caleb Etheridge & Saml. Ferrebee or any 3 of them audit & settle the accounts of Levin Dunton the present guardian of the orphans of Jacob Dunton decd. with the admr. of Danl. Dunton the former guardian.

Ordered that Wm. Etheridge Jun. have the right of admr. on the estae of Isaac Brown decd. who entered into bond with Benjamin Brickhouse & Willo. Wheatley in £100. Ordered that said admr. sell.

Ordered that John Williams be appointed guardian to Eliza, Thos., Wm., Tully, Susannah & Sarah orphans of Chs. Williams decd. who entered into bond with Dennis Dozier Sen & Richd. Jarvis securs. in £100 each orphan.

Ordered that xxx Creef be allowed £5.12.6 fror one months lying in with a bastard begotten by Saml. Tatum to be paid in equal quarterly parts.

Ordered that Zorobabel Harrison have the right of admr. [inserted: "de bonis non"] on the estate of John Sanderson son of Thos. S. who qualified & gave bond with Thos. Poyner & Thos. Sanderson in £1000.

Ordered that the admr. of John Sanderson sell two negroes Bets & Isaac for six months credit formerly in possession of Ann Sanderson.

Ordered that Edwd. Bunnell, Danl. Lee, Andrew Butts & Zachariah Morse or any three of them audit & settle the accounts of Grace Creff [sic] admx. of John Creef decd.

Ordered that James Williams be appointed overseer of the public road from the court house to Jollif Halsteads road in room of John Tatum.

Ordered that Jeremiah Linton be appointed constable in Tulls Creek district in room of Moses Bunnell resigned, who qualified as such & entered in to bond with Davis Ballentine & Saml. Scott in £500.

Nathl. Hutchins vs. Peggy Hutchins} Petn. On hearing the petition read &c. Ordered that Saml. Whitehurst Sen., Cyprian Shepherd, Jeremiah Bright, Joseph Ferrebee & Jacob Perkins meet with the county surveyor to divide the real estate of Peggy Hutchins decd.

Ordered that Tatum Brabble be appointed overseer of the backwoods road from Burrus Matthias out to the schoolhouse in room of Wm. Brabble.

Ordered that Caleb Cox Esq., Thos. Luffman, Davis Ballentine, & Peter Morse be appointed commissioners to lay off to Mary Brown widow of James Brown her years provisions.

On hearing the petition of Saml. Beasley admr. of Charlotte White decd. in order for a division among her lawful heirs, first advertising the same according to law, it is ordered that he sell negro man Jack on a credit of 6 mo.

On hearing the petition of Solo. Ashbee guardn. to Wm. Ashbee orphan of Abel Ashbee decd., it is ordered that Solo. Ashbee guardn. &c. advertise & sell on a credit of 6 mo. the half of a schooner called the Virginia & materials which half belonged to his ward & make return to next court.

On hearing the petition of Thomas Poyner admr. of James Wall decd. it is ordered that said admr. advertise & sell a negro woman Joan & boy Stephen the property of sd. James on a credit of 6 mo. & make return next court.

On hearing the petition of Henry Ballentine guardian of Davis Bright orphan of Henry Bright decd., it is ordered that sd. guardian advertise & sell the negroes[...]

Thos. Farrow vs. Elijah Farrow & als} Non est factums Payt. & set off
Jury to wit 1 Wallis Bray, 2 John Mackie, 3 James Dozier Sen., 4 Thos. Gray, 5 Luke Hill 6 Jona. Hall, 7 Joshua West, 8 James Cowell, 9 John Church, 10 Saml. Whitehurst 11 Saml. Dauge, 12 Philip Dauge impannelled & sworn say it is the deed of the deft., that there is no payt. or set off & assess the plffs. damage to £12.10.6 value of the obligation £136.12.6.
Whereupon the deft. prayed an appeal which was granted his atto. A. N. Vail Esq. filing the following reason to wit Thos. Farrow vs. Elijah Farrow & als -- I am of opinion that the verdict in this case is contrary to law & evidence which is sufficient for an appeal. Nov. Term 1810.

Ordered that the admr. of Thos. Marchant decd. sell as many negroes of sd. decd. for 6 mo. credit as shall be sufficient for the payment of the debt first advertising the same according to law.

Ordered that Saml. Ferrebee, James Nicholson, Thomas Baxter & Andrew Duke Esq. or any three of them audit the accounts of Caleb Etheridge Guard. to Fanny Kellum & Wm. Jarvis her husband & make return.

Ordered that Saml. Salyear Esq., Joseph Gray, Thomas Sanderson Esq., & Thomas Poyner Esq. or any three of them audit & settle the accounts of Edwd. Hollowell admr. of Wm. Hollowell decd. & make return.

Ordered that the same men audit & settle the acts. of Edwd. Hollowell admr. of Saml. Hollowell decd. & make return.

Ordered that Saml. Allcock orphan of Solomon Allcock Decd. be bound apprentice to Philip Douge Sen. until he arrives to the age of 21 years he agreeing to give him education as far as the rule of three.

Ordered that Thomas Snowden be appointed overseer of the road from Indian ridge by Joseph Tatums to the great swamp instead of Saml. Whitehurst.

Ordered that the Sheriff sell at public sale a negro man named Christopher on a credit of 6 mo. first advertising him agreeable to law in order for a division & make return.

Ordered that Leavin Dunton be appointed overseer of the road from James Nicholsons to the bounds of the great swamp instead of J. Taylor.

Ordered that Thomas Poyner, Danl. Lindsey & Jona. Lindsey appraise & divide the negroes belonging to the esate of Joseph Gray decd. equally among his lawful representative & make return to next court.

Ordered that a commission issue to Benj. Dough Esq. to take the private examination of Elizabeth wife of Spencer Midyett concerning a deed made to Harmon Brickhouse by sd. Spence & Elizabeth & make return.

On motion ordered that Danl. Lindsey, Thos. Sanderson, Jona. Lindsey, Thos. Whitehall, Jasper Pickett & Mitchell Simmons be appointed commissioners to divide the lands formerly the property of Thomas Sanderson decd. (Sen.) between the heirs of Ann Poyner & Lydia Woodhouse & make return next court.

On motion it is further ordered that Hezekiah Woodhouse be appointed Guard. pro temp for his two children Dorcas & Hadley to see that the division be made in their behalf.

Ordered that Andrew Duke Esq., Caleb Etheridge, Saml. Salyear Sen. and Saml. Ferebee be commissioners to lay off Director Dunton, widow of Danl. Dunton decd. so much of the stock, crop & provision of sd. decd. as shall be sufficient for one years support, under act of Assembly.

Ordered that Ann West be allowed the sum of £12 for 1808, £8 for 1809 & £6 for 1810 for maintenance of a bastard child begotten in her body by Danl. Dowdie. Clk. to issue exr. for said allowances.

Ordered that all former orders be continued for return as to auditing &c.
