8 Dec 1870 - Lovey Ann BALLANCE vs. Kiziah, Allen, Wesley E., Wm. L., Dempsey and Charles BALLANCE - Petition for guardian ad litem; children are all under 21 years of age and live with their mother, Lovey Ann; they ask the Court to appoint Wiley MATHIAS their guardian ad litem. /s/ B.M. BAXTER, Atty for Petitioners; Wiley MATHIAS agrees to be guardian. /s/ Wiley MATHIAS
9 Dec 1870 - Petition for Dower - Lovey Ann BALLANCE, widow of Wesley BALLANCE states that her husband died in the month of [nothing written] 1870 leaving him surviving the following children: Keziah, Ann, Allen, Wesley E., Wm. L., Dempsey and Daniel BALLANCE all of which are under 21; that at the time of his death he was seized of 2 tracts of land in Moyock Twp. in Currituck County, one tract adjoining the lands of George W. POWERS, Mary SMITH and the main road, it being the home tract containing 56 acres, the other tract adjoined G.W. POWERS, the heirs of Major COX, Wm. J. POWERS and the main road containing 36 acres. /s/ B.M. BAXTER, Atty for Petitioner

10 Nov 1871 - Petition for Partition of Land by W.H. POWERS, C.C. POWERS, R.J. POWERS, Noah McPHERSON & wife Mary A., George GARRETT and wife Martha A., plaintiffs, vs. Margaret A. POWERS and Thos. J. POWERS, by their guardian ad litem, defendants; Plaintiffs as that commissioners be appointed to make a plat of a piece of land adjoining the lands of Wesley BALLANCE, decd, and others and another piece of land joining [nothing written] POWERS and make and equal partition amongst the parties entitled to his or her share. /s/ A.O. DEY, C.S.C.
1 June 1877 - Notice to sell land - Land to be sold on Monday, July 9, 1877 by C.W. GRANDY, Special Commissioner; the lands belonging to Westley BALLANCE decd, for partition amongst his heirs-at-law. One piece of 50 acres near Great Swamp in Back Woods adjoining George POWERS heirs and others; another piece of land of 30 acres adjoining the land of the heirs of George POWERS, W.C. MERCER and others, all subject to widows dower. Term of sale 1/3 cash and the balance on a credit of 6 and 12 months interest from date.
