6 Apr 1888 - Summons for Relief - W.H. BRAY & W.C. MERCER against J.L. DeCORMIS, guardian of E.N. & Lenora BELANJA. The plaintiffs allege that J.L. DeCORMIS was duly appointed and qualified as guardian of Earnest N. and Lenora BELANJA and for the performance of his duties he entered into a bond payable to the State of NC for $3000 with W.H. BRAY and W.C. MERCER as his securities; that the said guardian has received about $2000 on behalf of his wards; that they are informed and believe that the defendant has neglected to invest & manage the said funds towards the benefit of his wards and is in violation of his duties and is using the funds for his own use; that they believe said defendant is insolvent and that they are in danger of sustaining loss by virtue of their security to the full amount of the money received by said guardian. Therefore plaintiffs pray that the defendant be required to give another bond or to indemnify the said sureties from all loss or that he be removed from his trust. /s/ J.H. 9 Apr 1888 - Defendant's Answer to Plaintiffs - DeCORMIS admits that the first allegation is true except to the amount of penalty which is in fact $4000 with the plaintiffs and H.M. SHAW & Jno. F. FROST as sureties; that the allegations are untrue and there was no necessity for this proceeding and that it was instituted for the sole purpose of annoying the defendant and he believes he ought not to be charged with any costs in this case. /s/ W.B. 7 May 1888 - This cause coming on to be heard before H.B. ANSELL, Clerk of the Superior Court, and it appearing that the defendant DeCORMIS has given a sufficient bond to secure the performance of his duties as guardian of Earnest N. BELANJA and Lenora BELANJA, the said bond being completed since the bringing of this action. It is therefore ordered that W.H. BRAY & W.C. MERCER, sureties on DeCORMIS' bond given on the 5th day of March 1885, be released from further liability as sureties. It is further ordered that defendant pay the costs incurred in this proceeding. /s/ H.B. ANSELL, CSC
