In the name of God Amen, be this my Last Will and Testament, I Samuel ASHBEE of the County of Currituck and State of North Carolina, being in sound mind and good judgment but knowing from a course of nature I cannot long survive and wishing to dispose of my property to suit myself.

Item 1st I give and bequeath all my possession of land house hold and kitchen furniture with all my stock boats etc to my beloved child Mary Ann Spencer ASHBEE to her and her heirs forever.  I also lend to my beloved wife Sally ASHBEE all my house hold & kitchen furniture stock boats etc. land also her life estate or widowhood in a third part of the land where I now life, if she ever marries to have nothing.

Item 2nd I also give and bequeath to my beloved daughter Mary Ann Spencer ASHBEE my interest of land on Bodies Island containing 50 acres more or less. Signed by my own hands this 20th Jany 1851.

Currituck County Court August Term 1851
   A paper writing purporting to be the last will an testament of Samuel ASHBEE was exhibited in open court and the execution of the same was proved by the oath of Samuel BEASLY one of the witness to the same who proved said ASHBEE signed published and declared said paper writing as his last will and testament, that said BEASLY signed the same at his request and in his presence and at the time thereof said testator was of sound mind and disposing memory ordered and adjudged the said paper writing be and is hereby admitted to probate as a last will and testament passing both personal and real estate.
