In the name of God, Amen. I, Maurice BAUM, SENR. of the State of North Carolina, County of Currituck, Roanoke Island, being of Sound and perfect mind and memory blessed be God, do this twentieth day of July in the year of our Lord, one thousand eight hundred and four, and publish this my last Will and Testament in Manner following that viz. to Say.
First I leave unto my beloved wife Judith BAUM my houses and plantation, whereon I now live with the priviledge of firewood and rail timber and also Six Negroes to wit--Reuben, Esther, Hannah, Rachael, Lydia, and Livius during her natural life or widowhood. This my will and desire viz So that after my said wife's decease, that the negro boy called Livius shall descent unto my Son Daniel BAUM for his use benefit and behoof Also my will and desire is So that the other above mentioned Negroes shall be equally divided amongst all my sons and daughters for their use benefit and behoof Likewise I leave unto my said wife Judith three featherbeds and furniture, and two horses and one Mare, their names as following to wit--Jack, Dave and Diamond. Also five cows and calves, during of her natural life, or widowhood. And after my wife's decease my will is so that the above mentioned Beds, horses, and cattle Shall be Equally divided amongst my Sons and daughters for their use benefit and behoof My will and desire is So that all my household furniture such as Earthen plates, Stone, and Iron except one third part taken out for my said wife's use shall be equally divided amongst my Sons and Daughters for their use and behoof My will and desire is so that all my wooden ware Shall be equally divided amongst my Sons and Daughters except the third part to be taken out for my wife's use and benefit.
Item--I give and bequeath unto my Son Alpheus BAUM one Certain Tract of land lying and being on the Northeast side of Roanoke Island, beginning at the northwest side of My new ground running a westwardly course along the Bank to Solomon ASHBEE's line, to the from thence along said line to main road then Down said road to Daniel BAUM's line from thence to the first Station, for his use and benefit.
Item--I Give and bequeath unto my Son Daniel BAUM a Certain tract of land joining the land of Alpheus BAUM and Maurice Junr. and running their line to the main road for his use and benefit.
Item--I give and bequeath to my son Daniel BAUM the Tract of land whereon I now live, after my said wife's marriage or decease, the Same beginning at the Southeast Corner of Maurice BAUM JUNR's line and running southeast So far as Contains the width of my plantation thence SW to the main road then along Maurice Baum Junr's line and along said line to first station for his use and benefit.
Item--I Give and bequeath unto my two Sons Alpheus and Daniel BAUM all my pasture land that is Contained within fence for their use and benefit.
Item--I give and bequeath unto all my Sons and daughters all my broad Creek marsh of Bodies Island equally to them all for a proviledge for their use and benefit. My will and desire is So that my two Sons Alpheus and Daniel BAUM Shall Have three featherbeds and furniture equally between them for their use and benefit. My will and desire is So that my white mare Shall belong to my Son Abraham for his use and benefit.
Item--My will and desire is So that my bay mare and all the old bays on Bodies Island Shall Belong unto my daughter Tilpha MASON, for her use and benefit.
Item--My will and desire is So that my next oldest Creature on the Bodies Island the foal of the old bay mare, Shall belong to my Daughter Nancy DANIEL for her use and benefit.
My will and desire is so that my next oldest creature on Bodies Island shall belong to my Daughter Sabra ETHERIDGE for her use and benefit.
My will and desire is So that my schooner called the Union be equally possessed and owned Between my said wife and Sons Abraham and Daniel BAUM, and at my said wife's marriage or decease, my will is So that my said wife's third of Said Schooner shall be equally divided between my said two Sons Abraham and Daniel BAUM for their use and benefit.
My will and desire is So that the one third part of my Schooner called the Dolphin shall be possessed and owned by my Said wife during of her natural life or widowhood and the other two thirds to be possessed and owned by my Son Alpheus BAUM and at my said wife's marriage or decease, my Said wife's third of Said Schooner shall be possessed by my son Alpheus for his use and benefit.
My will and desire is So that at my decease my Grand Daughter Sabra shall have one Negro Girl called Lovie for her use and benefit.
My will and desire is So that my daughter Nancy DANIEL shall at my decease have one Negro Boy called Oliver, for her use and benefit.
My will is that my daughter Tilpha MASON, Shall at my decease, Have One Negro Girl called Selah for her use and benefit.
My will is that my daughter Sabra ETHERIDGE Shall have one Negro Boy called George, for use and benefit.
My will and desire is that my Negro man Called Sammy and my Stud Horse Should be Sold at public Sale and three hundred dollars of the money converted to the use of Building my Son Alpheus a house, and also my Sailing boat to be Sold in like manner, and the money that Shall remain over three hundred Dollars will be equally divided among all my Sons and daughters for their use and benefit.
My will and desire is So that my three Daughters to wit--Nancy DANIEL, Sabra ETHERIDGE, and Tilpha MASON Shall have three head of Common cattle apiece for their use and benefit.
My will and desire is So that all the remaining part of my Cattle that is not before mentioned Shall be equally divided among all my Sons and daughters for their use and benefit.
My will and desire is So that my Son Daniel BAUM Shall have one Negro called Joe, at my decease for his use and benefit.
My will and desire is So that my son Alpheus BAUM Shall have one Negro boy called Frank at my decease for his use and benefit.
My will is So that all my Hoggs and Sheep Shall Go to the use of the household family of my Own house, that Shall remain behind me for their use benefit.
My will is So that my negro boy called Jack after my decease, Shall be Equally divided amongst my three daughters Nancy DANIEL, Sabra ETHERIDGE, Tilpha MASON for their use and benefit.
My will and desire is that my Son Abraham Shall have my long Gun And James MASON my Cattle Gun, my Son Daniel my musket and my Son Alpheus my hunting Gun for their use and benefit.
My will is So that my fishing Canoe Shall remain for the use of the house all the flax and Cotton about my house I leave to the use of the house.
My will is So that the Cash that is in a Certain Bag Shall be Given unto my Grand Daughter Sabra ETHERIDGE and also the money due from James MASON on the account of the Sloop and I hereby make and ordain my Worthy Sons Abraham and Alpheus BAUM, executors, of this my last Will and Testament, in witness whereof I, the said Maurice BAUM SENR., have to this my last Will and Testament Set my hand and Seal the Day and Year above written Signed, Sealed, published and declared by the Said Maurice BAUM the Testator, as his last Will Testament, in the presence of us who were Present at the time of Signing and Sealing hereof witnessed.
