The last will and Testament of Mary BAXTER Dec’d
I Mary BAXTER of the County of Currituck and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this to be my last will and Testament in manner and form following that is to say:
First - That my executors herein after named shall pay all my funeral expences together with my just debts out of the moneys that may first come into his hands as a part or parcel of my estate.
I give and bequeath unto my nephew Joshua W. BAXTER and James O. BAXTER, all my interest and title in and to boy John to them and their heirs forever.
I give and bequeath unto my niece Bridget WILLIAMS all my interest and title in and to woman Bashaba to her & heirs forever.
I give and bequeath unto Benjamin F. BAXTER and Mary Susan BAXTER my interest and title in and to girl Penny to them and their heirs forever.
I give and bequeath unto William F. BAXTER son of Thomas BAXTER and Joshua W. BAXTER my interest and title in and to girl Dolly to them and their heirs forever.
I give and bequeath unto Margaret WILLIAMS my interest and title in and to girl Albina to her and her heirs forever.
I give and bequeath unto Thomas F. BAXTER and Joseph J. BAXTER all my interest and title in and to boy Thadeus to them and their heirs forever.
I give and bequeath unto Mary Susan BAXTER my best bed and furniture and my deep table to her and her heirs forever.
I give and bequeath unto Adelia PIGGETT daughter of Joseph BAXTER the second choice of my beds to her and her heirs forever.
I give and bequeath unto Bridgett WILLIAMS my large walnut chest & draws & rocking chair to her and her heirs forever.
I give and bequeath unto Jerome B. BAXTER all my interest and title in and to all my lands & every thing thereunto belonging to him and his heirs forever.
I give and bequeath unto Joshua W. BAXTER the remainder of my property of every description whatever that I have not already given away to him and his heirs forever.
And lastly I do hereby constitute and appoint my friend Joshua W. BAXTER my executor to this my last will and testament hereby revoking and declaring utterly void all other wills & testaments by me heretofore made. In testimony whereof I the said Mary BAXTER do hereunto set my hand and seal this the 10th day of August 1858.

Signed sealed published and declared by the said Mary BAXTER to be her last will and testament in the presence of us who at her request and in her presence and in the presence of each other do subscribe our names as witnesses thereto.

The foregoing paper writing purporting to be the last will and testament of Mary BAXTER was exhibited in open court by J.W. BAXTER the executor therein named and examination of James WILLIAMS & A. M. CUNNINGHAM the subscribing witnesses thereto in due form of law on motion it is ordered that the same be recorded as the last will and testament of the said Mary BAXTER and at the same time appeared J.W. BAXTER the executor therein named and qualified as executor therein.Attest: J.W. BAXTER, CCC
