In the name of God Amen, I Hilary BURTON of Currituck County, and State of North Carolina being weak in body but of sound and perfect memory blessed be God for it do make ordain and publish this my Last Will and Testament in manner and form following Viz.
Item: I give and bequeath to my Son BURTON (sic) thirty three acres of one quarter of juniper swamp land and one mare provided he lets his Mother have the use of said mare when she wants to him and his heires forever
Item: I give and bequeath to my beloved Wife Fanny BURTON during her life or widowhood all the residue of my estate either real or personally that I shall die possessed of and after the death of my said Wife or marriage to be equally divided among my beloved children Viz, John BURTON, Frankey TAYLOR, Fanny BURTON and Sally BURTON to them and their heirs forever and I also appoint my Brother John BURTON whole and sole executor to this my Last Will and Testament in witness whereof I the said Hilary BURTON have to this my Last Will and Testament set my hand and seal this 6th day of July in the year of our Lord one thousand seven hundred and eighty eight.
