The last will and Testament of Joshua DAVES was exhibited in open court at November Term 1841 and proved by the oath of Edmund JONES one of the subscribing evidences there to in due form ordered Recorded.
In the name of God Amen, I Joshua DAVES of the County of Currituck in the State of North Carolina, being sick but of sound disposing mind and memory do make and publish this my last will and testament in manner and form as follows.
Item I give and bequeath to my wife Fanny DAVES the following property two beds and furniture first choice, one desk, one cubboard, two chest, first choice, two tables, six chairs first choice, all my iron ware, all my crockery, knives and forks and spoons two cows and calves first choice if the cows have calves, eight head of sheep first choice, one sow and pigs first choice four head of dry Hogs, first choice and all my poultry corn and pork and other articles enough for her years provision.
Item I leave the balance of my estate to be sold and the money arising there from out of which I give to my Brothers Son Elias DAVES Fifty dollars to be paid to him when he arrives at the age of twenty one years and in case the said Elias DAVES dies before he arrives at the age of twenty one years I give the said Fifty dollars to Gideon BONNEY Son of Jonathan BONNEY and William CHAPLE Son of George , and the balance of said money arising from the sale of said property after paying all my just debts I leave the said property to be equally divided between Gideon BONNEY Son of Jonathan and William CHAPLE Son of George and in case the said Gideon BONNEY and William CHAPLE dies without lawful heirs begotten of there bodies I leave said property to be equally divided between Gabril WILKINSON & Erasmus CHAPPLEs children, each to have their part, when they arrive to the age of twenty one years.
Lastly I Constitute nominate and appoint my friend John B. JONES Executor to this my Last Will and Testament, revoking all former wills by me made. In witness whereof I have here unto set my hand and caused my seal to be affixed this 16th day of Novr. 1839.
