The last will and Testament of Jeremiah ETHERIDGE

   I Jeremiah ETHERIDGE of the county of Currituck and State of North Carolina being of sound mind & memory, but considering the uncertainty of my earthly existence do make and declare this my last will and Testament in manner & form following that is to say:

   Firstly that my Wife Elizabeth ETHERIDGE I shall leave my whole executor herein after named shall provide for my body a decent burial suitable to the wishes of my friends & relations and the said Elizabeth paid all funeral expences out of my estate.

   Item - I lend to my beloved Wife Elizabeth ETHERIDGE all of my real estate together with all of my chattle property namely all of my household and kitchen furniture together with one canoe, & one mare & colt & my stock of all cainds durin her lifetime her widowhood. She havin full power to sel every pocein [portion] of my property that she thinks best to pay my just debts that I have contracted in my life time & should she marry or at her death the balance of my property after payin my debts boath real & personal to be equally divided amongst my lawful heirs namely Elizabeth ETHERIDGE & Benjamin B. ETHERIDGE & Lovey ETHERIDGE & Matilday ETHERIDGE & Mary ETHERIDGE & Machagey ETHERIDGE & Bethany ETHERIDGE and after valuin & conciderin the above & last I do hereby constitute and appoint my beloved Wife Elizabeth & have named by lawful executor to all intents & purposes to execute this my last will and testament according to the true intents & meaning of the same & every part & clause tharof hereby revoke & declared utterly void all other wills by me maid in witness whereof  I the said Jeremiah ETHERIDGE doth this day hear unto set my hand & seal this 5 Oct. 1858.

Court of Pleas & Quarter Session - November Term 1858
   The foregoing paper writing purporting to be the last will & testament of Jeremiah ETHERIDGE dec’d was exhibited in open court & propounded for probate and the same was proved by the oaths & examination of William HAYS & Joshua JOHNSON the subscribing witnesses thereto in due form of law on motion it is ordered that the same be recorded as the last will and testament of the said Jeremiah ETHERIDGE.
