Currituck County Wills
In the name of God Amen, I Benjamin EVENS of Powells Point Currituck County and Province of North Carolina being of perfect mind and memory blessed be God for it and calling to mind the frailty of nature with the shortness of Life and certainty of death, I do make and ordain this my Last Will and Testament Viz. Principally and first of all I recommend my soul into the hands of Almighty God that gave it and my body to the descretion of my executors, nothing doubting but that at the resurrection I shall receive the same by the Almighty power of God; and as for my worldly estate of goods which hath pleased God to bestow upon me in this life I give demise and dispose of the same in the following manner and form.
Item: I give and bequeath to my Daughter Easter MASON one hundred and seventy acres of land to her and her heirs forever. Whereon she now lives to be laid of according to the run of the pattent begining at the sound and running to the head of the line.
Item: I give to my Daughter Lydda DAVIS to her and her heirs forever one hundred and eighty acres of land adjoining my Daughter Esthers and concluding the whole of the same patent to be laid of according to patent begining at the sound and running to the head of the line.
Item: I give to my Daughter Jean EVENS to her and her heirs forever all the tract of land which I bought of my Brother Henery EVENS excepting an island called and known by the name of Long Island.
Item: I give to my two Sons Benjamin EVENS and John EVENS to them and their heirs lawfully begotten of their bodies forever the plantation wheron I now dwell to be divided betwixt them by a line beginning at a poplar at the edge of the swamp running across the plantation to a markd pine runing from thence to a line of markd trees that formerly was a dividing line betwixt me and John FURBUSH that to be the dividing line betwixt my two Sons my Son Benjamin to have all that part of the said tract that sicth to the northward of the aforesd line and my Son John all that part of the tract to the Southward . I likewise give unto them the island called Long Island being part of the tract of land I bought of my Brother Henery to be enjoyed equally by them both; I likewise give to my Sons Benjamin and John three cows and four young cattle apeice, I likewise give to my Son Benjamin one young negroe man named Daniel to be taken in possison when he comes of age to him and his heirs forever, I likewise give to my Son John one negro man named George to be taken in possesion at the death of his Mother to him and his heirs forever, and if either of my two Sons should die without heirs lawfully begotten of his body my will is that the deceased Sons part should decend or fall to the survivor.
Item: I give to my Son Benjamin my Son John and my Daughter Jean to each of them one feather bed and furniture.
Item: I lend to my well beloved Wife Sarah EVANS during her natural life, or state of widowhood the following negroes Viz. Kate, George, Jude and Daniel till my Son Benjamin comes of age with all my houshold furniture excepting such as I have given in legasies to my children to be enjoy by her as aforesaid and when my Wife dies or marries then I give my negro Wench Jude and all the increase she then has or evedently goes with to my three Daughters Esther, Lyda and Jean and after the death or marriage of my Wife I give my negro woman Kate unto my Son Benjamin during his natural life and then to fall to my Daughter Esther.
And Lastly I appoint my well beloved Wife Executrix and my two Sons Benjamin and John executors of this my Last Will and Testament makeing void and disanulling all other wills or legasies formerly made by me declaring this and this only my Last Will and Testament. In witness whereof I have hereunto set my hand and seal this the twentieth day of November in the year of our Lord one thousand seven hundred and seventy six.
