It is to be remembered that at an inferior (illegible and torn) and quartery session began on ??? house in and for the County of Currituck (illegible) on the first Tuesday in April bein the ???? the Reign of our Sovereign Lord ??? as he this by the Grace of God King of Great Britain (torn) Anno Domino 1764Michael O'NEAL and Moses FANSHAW Executors of (torn) Last Will and Testament of Moses FANSHAW late of Currituck County aforesaid Planter deceased appeared in open Court where they exhibited the aforesaid Will ???? might be admitted to prove it which was granted ???? by the oaths of Absalom LEGGETT, James GINKENS Benjamin DAUGE three of the subscribing evidences thereto and (torn) same time the aforesaid Executors took the Executors in one form of Law whereupon it was then ordered that the Secretary of this Province have (torn) thereof that ???? Testamentary may give thereon and (torn) the same Will be recorded as the said ??? (possibly deceased) which are (torn) follows in these words, To wit:
In the name of God Amen I Moses FANSHAW (torn) County in the Province of North Carolina being (torn) and weak in body but of good and perfect memory (torn) be to God for it therefore calling to mind the (illegible and torn) my body and knowing that it is appointed for all men (torn) do make and ordain this my Last Will and Testament that (torn) Princepally and first of all I give and recommend my Soul (torn) signed of God that gave it and as for my body I recommend (torn) earth to be buried in a Christion like and decent manner (torn) discretion of my Exto? Hereafter named nothing doubting but (torn) general resurrection I shall receive the same again (Illegible and torn) Power of God and as touching such worthly estate Where will (torn) Pleased God to bless me in this Life.I give revise of (illegible and torn) Same ???? manner and form ( Rest of line illegible and bottom part of page torn)...
...and his heirs forever. I also give him two cows and year old (torn) cow and calf and one two year old heffer which is in his (torn) mark. I also give one seald(?) gold ring and two geese(?) and one (torn) new sadle and one sword and one horse. I also give him two (torn) large chest , one large pot and one small pot to be paid (torn) to him at my Death.
Item: I give and bequeath unto my well beloved Daughters Sarah FANSHAW and Rebekah FANSHAW all the remainder part of my cattle they and their increase and all the rest of my Estate to (torn) equally devided between them and if any one of them Dies without lawfull isue then to fall to the other to be paid to them at my death.
Item: I also make and ordain my Well Beloved friend Michael O'NEAL with my son Moses FANSHAW to be my only and Soul Exet. of this my Last will and Testament and utterly revoking disalowing and disanulling all and every other former will or wills by me hear to fore willed named or bequeathed in testamony where of I have here unto set my hand and afisct my Seal this 19 day of April 1760.
