Currituck County Wills

 L.H. [Little Hodges] Gallop

[The Currituck will books are no longer in the courthouse but have been sent to the Archives in Raleigh.  Currently they only have wills in envelopes dating from about 1900 and later filed in metal drawers.  This will was in the drawer of loose wills.]

This is my Last Will and testament.
North Carolina Currituck County

I L. H. GALLOP of the aforesaid County and State being of sound mind but considering the uncertainty of my earthly existence do make and declare This my Last Will and Testament.

First- First my executor herein after named shall give my body a decent burial and pay all funeral expenses together with all my just debts out of the first money which may come into her hands belonging to my estate.

Second-I give and devise to my beloved wife all of my Insurance money with The Jefferance Life Insurance company and the Junior order and all stock on hand at my death and her life time wright in my estate where I now live.

Third-I give and devise to my daughter Lucinda and her heirs in fee simple a tract of land in Poplar Branch township Currituck County adjoining the lands of R. L. GRIGGS and Frances EVANS to my south wire fence with the exception of a cart road along the line of R.L. GRIGGS and Frances EVANS to the Currituck sound to have and to hold for ever and all improvements there on.

Fourth-I give and bequeath to my Son Hodges the house and a potion of the land commencing at the main road at the wire fence south of my house thence up the main road to my north gate post. Thence a straight line a crost the field to Marion GALLOPs land to have and to hold for ever.

Fifth-I give and bequeath to my daughter Clara H. a tract of land commencing at my north gate post the same line as a bove mention thence a long the main or county road to my north wire fence to a litewood post thence a straight line to Marion GALLOP land and all improvements thereon to have and to hold for ever.

Sixth-I give and bequeath to my daughter Filena from my said north fence mention a bove thence all the land from my north wire fence to S.G. SAWYER line thence down S.G. SAWYER line to Marion GALLOPs line with thease exceptions that all the heirs are to have a privelage to the swamp to get wood and maner or mud and all improvements thereon to have and to hold for ever.

Seventh-All of my children are to have a right to the roade mention in the first sexion to the sound.

Eighth-I hereby constitute and appoint my wife Sidney C. GALLOP my lawful executor to all intents and purposes to execute this my last will and testament according to the true intents and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made in witness whereof I the said L. H. GALLOP do hereunto set my hand and seal this 12 day of April 1913.

Signed sealed published and declared by the said L. H. GALLOP to be his last will and testament in the presence of us who at his request and in his presence and in the presence of each other do subscribe our names as witnesses thereto.

PROBATE OF WILL UPON EXAMINATION OF WITNESSES

Currituck County }  SS.  In the Superior Court
    A paper writing purporting to be the last will and testament of L. H. GALLOP deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by Sydney C. GALLOP the executrix therein mentioned, and the due execution thereof by the said L. H. GALLOP by the oath and examination of E. L. OWENS & Maggie SMITH, two of the subscribing witnesses thereto: being duly sworn, doth depose and say, and each for himself & herself deposeth and saith that he & she is a subscribing witness to the paper-writing now shown them purporting to be the last will and testament of L. H. GALLOP that the said L. H. GALLOP in the presence of this deponent, subscribed his name at the end of said paper writing, now shown as aforesaid, and which bears date of the 12th day of April 1913.
    And the deponent further saith, that the said L. H. GALLOP the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited, to be his last will and testament, and this deponent did thereupon subscribe his & her name at the end of said Will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of deponent’s subscribing his & her name as an attesting witness thereto, as aforesaid, the said L. H. GALLOP was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.

It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of L. H. GALLOP, deceased.  Let said Will, together with the probate, be recorded and filed.  This 4th day of October, 1915.

APPLICATION FOR LETTERS TESTAMENTARY

Currituck County:  In the Superior Court Before E.W. ANSELL - In the Matter of the Will of L. H. GALLOP, deceased
   
Sydney C. GALLOP being duly sworn, doth say:  That L. H. GALLOP, late of said County, is dead, having first made and published his last Will and Testament: and that Sydney C. GALLOP is the executrix named therein.
   Further, that the property of the said L. H. GALLOP consisting of household & kitchen furniture, stock, farming utensils & horses, hogs & cattle is worth about $300.00, so far as can be ascertained at the date of this application and that Sydney C. GALLOP the widow, Lucinda GALLOP, Hodges GALLOP, Clara H. GALLOP, Filena GALLOP, P.O. Harbinger, N.C. are the parties entitled under said will to the said property.

EXECUTOR'S OATH

I Sydney C. GALLOP do solemnly swear that I believe this paper writing to be and contain the last will and Testament of L. H. GALLOP that I will well and truly execute the same by first paying his debts and then his legacies, so far as the said estate shall extend, or the law will charge me, and all other duties pertaining to the office of Executrix I will discharge according to law, to the best of my skill and ability. So help me God.
