Tully Halstead
Sept. 19, 1868 - May 29, 1872

    Currituck County     }

In the name of God Amen.  I Tully HALSTEAD of the County & State aforesaid being of sound mind & memory do make publish and declare this my paper writing to be my last will and testament in manner & form as follows to wit:

First: I loan to my beloved wife Sarah during her life or widowhood all of my estate of every kind real & personal, notes & money, and at the death or marriage of my wife Sarah, I loan all of my estate of every kind to Elizabeth FEREBEE wife of Enoch D. FEREBEE in trust for the benefit of the children of the said Elizabeth FEREBEE the said property & estate to be in no way liable or subject to the debts or in no way to be controled by the said Enoch D. FEREBEE, and at the death of the said Elizabeth FEREBEE I give and bequeath all the said estate to the children of the said Elizabeth FEREBEE living at the death of said Elizabeth FEREBEE.  Witness my hand & seal the 19th Sept. 1868.

Signed sealed & declared by this testator to be his last will & testament in our presents & in the presence of the testator.

Currituck County - In the Probate Court
    A paper writing purporting to be the last will and testament of Tully HALSTEAD deceased, is exhibited before me, the undersigned Judge of Probate for said County and the due execution thereof duly  by the said Tully HALSTEAD by the oath and examination J.W. BAXTER, one of the subscribing witnesses thereto and the handwriting of J.B. LEE decd. whose name is attached thereto who being duly sworn doth depose and say, that he is a subscribing witness thereto the paper writing now shown him purporting to be the last will and testament of Tully HALSTEAD, that the said Tully HALSTEAD in the presence of this deponent subscribed his name at the end of said paper writing, which is now shown as aforesaid and which bears date on the 19th day of Sept. 1868.
    And the deponent further saith, that the said Tully HALSTEAD the testator aforesaid, did at the time of subscribing his name, as aforesaid, declare the said paper writing so subscribed by him, and exhibited, to be his last will and testament and this deponent did thereupon subscribe his name at the end of said will, as an attesting witness thereto and at the request and in the presence of the said testator.  And this deponent further saith that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponents subscribing his name as an attesting witness thereto, as aforesaid, the said Tully HALSTEAD was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge information or belief of this deponent.  And further this deponent saith not.

    H.E. BAXTER and Thos. F. BAXTER being sworn say each for himself that he is well acquainted with the signature of J.B. LEE and that he believes that the signature of J.B. LEE attached to an instrument of writing purporting to be the last will and testament of Tully HALSTEAD to be in fact the signature of J.B. LEE.
