Transcript of the County court of Currituck County.  In the case of Alfred PERKINS alledged executor and for the divisees, the widow execepted, of John HUMPHERS deeased against Adelia HUMPHERS widow of  said deceased.  Issue: Is the paper writing offered the last lill and Testament of John HUMPHERS deceased.

Feby Term 1848
   The following jury was empanelled and sworn to try if the paper writing now read to the jury is the last will and Testament of John HUMPHERS deceased. William GOODMAN 1 Thomas R. BALLENTINE 2 Isaac T. AYDELOTT 3 Tully B. FANSHAW 4 Thomas F. BAXTER 5 Wilson BROTHERS 6 David MORSE 7 Edmund WOODHOUSE 8 Alexander DOXEY 9 Caleb J. ETHERIDGE 10 Dennis W. DUNTON 11 and William ETHERIDGE 12 and the said jury say that the paper writing is the Last Will and Testament of John HUMPHERS deceased from which verdict the defendant payed and obtained an appeal by given bond in the sum of Five hundred dollars with James M. FEREBEE and William FEREBEE sureties which bond is here with sent.

   I Benjamin T. SIMMONS Clerk of the County Court of Currituck County do hereby certify the above to contain a true copy of the records in the above case given under my hand and seal of office at Currituck the 10 day of March 1848.

Jury: Caleb J. ETHERIDGE 1 Thomas S. WOODHOUSE 2 William L. HARRISON 3 William A. JARVES 4 Peter PARKER 5 Tart ETHERIDGE 6 John NEWBERN 7 John BUNNELL 8 Richard J. LINDSEY 9 Jesse B. LEE 10 Edward H. WALKER 11 and Jonathan B. LINDSEY 12 empannelled and sworn to try the issue whether the paper writing exhibited is the last will and Testament of John HUMPHERS deceased say that the paper writing exhibited signed by said HUMPHERS deceased and witnessed by G.C. MARCHANT and Zero HAMELTON is the last will and testament of John HUMPHERS deceased ordered that the paper writing be transmitted to the Court of Pleas and Quarter Session of this County and that it be there admitted to probate as a will passing real and personal estate and that the executor qualify thereto.

   I Solomon ASHBEE clerk of the Superior Court of law for the County and State of aforesaid do hereby certify that the for going contains a true copy of the transmitted of the County Court and is the proceedings had in the Superior Court. In witness whereof I have hereunto set my hand and seal of office this 25th of May 1848.

Court of Pleas and Quarter Sessions May Term 1848 -- Justices present John JONES, Alexander SMITH, Tart ETHERIDGE and Wallis BRAY Esqrs.

   A transcript of the Superior Court in relation to a paper writing purporting to be the last will and Testament of John HUMPHERS dec’d in the case of Alfred PERKINS aledged executor etc etc against Adelia HUMPHERS being filed in this court it is adjudged that the said paper writing be admitted to probate as a will passing realty and personalty and that Alfred PERKINS the executor therein named be permitted to qualify as such who did appear in open court and took the oath required & ordered that the will and all the proceedings be recorded.

   I JohnHUMPHERS of the County of Currituck and State of North Carolina being of sound disposing mind and memory do make and ordain this my last will and Testament on this the Ninth day of October in the year Eighteen hundred and forty seven.

   I leave the whole of my estate both real and personal to be divided after the payment of my just debts amongs my heirs at law, as the law directs the division of property of intestates.

   And I nominate and appoint my friend Alfred PERKINS executor of my estate and Guardian to the whole of my children. In witness whereof I have here unto set my hand and affixed my seal the day and date above written.
