Currituck County Wills
The Last Will and Testament of Jeremiah LAND decd. was exhibited at August Term 1836 and proven by the oath of James H. HOLMES witness thereto and ordered recorded
In the name of God Amen, I Jeremiah LAND of the County of Currituck and State of North Carolina being weak in body, but of a sound disposing mind and memory, do make and ordain this to be my last will & testament hereby revoking all others by me heretofore made.
I give & demise to my three sons Thomas, Benjamin and James the tract or parcel of Land whereon I now live beginning at Col. WILLIAMS' line running his line south west to Col. ETHERIDGEs line, along this line to CAPPS' line, then various courses to the sound thence to the first station containing six hundred acres more or less of this tract of land it is my will and desire that Thomas S. LAND shall have one third to be laid off on the north side adjoining the lands of Col. John WILLIAMS, & Capt. HETFIELD & to cross the main road to a cross fence where a post is erected - that Benjamin LAND shall have one third to be laid off on the East Side adjoining the sound, the lands of Thomas BRUMSEY & to cross the main road at post erected upon the road that James M. LAND shall have one third lying between the shares of Thomas & Benjamin including the dwelling house and all the out houses to them and their heirs forever.
I give and bequeath to my son Thomas S. LAND two negro men Spence & Moses & negro woman Rate & her child Paul to him and his heirs forever.
I also give said Thomas four beds & furniture two of which he has already in his possession to him & his heirs forever -
I give and bequeath to my son Benjamin one negro man named George, one negro man named Dick and three negro girls already in his possession to wit Ann, Eliza & Amy - also four beds & furniture, two of which he has in possession to him and his heirs forever -
I give & bequeath to my son James M. LAND negroes Anthony, Jesse, & America negro woman Mary, Emeline, boys Mark & John and girl Eliza - also four beds & furniture, one of which he has in his possession one mahogany bed to him and his heirs forever -
The remainder of my estate both real & personal with the exception of that hereafter given to Thomas S. LAND in Trust including a tract of land adjoining the lands of Enoch FEREBEE & Samuel FEREBEE, called Crabb Island containing about five hundred & seventy acres. I desire to be sold by my executors hereafter named upon such terms as they may think proper at Private or Public vendue, except three old Negroes named Britt, Peggy & Fanny which I desire may be supported out of my estate or be disposed of as my executors may think proper - and out of the proceeds of the sale of the property aforesaid I desire my just debts to be paid and the balance to be equally divided among my three sons Thomas S. LAND, Benjamin LAND and James M. LAND.
I furthermore give to Thomas S. LAND the following negroes to wit - Phebe, Louisa & Bob - and negro woman Honour & fifty acres of land lying in Buckskin adjoining the lands of Edward HARDY & others for the benefit of my two Grand Children Virginia Elizabeth DAVIS & Jeremiah Land DAVIS to be paid & delivered to them when they arrive at the age of twenty one - & in case either of them should die before he or she arrives to the age of twenty one - then his or her share to go to the other, & in case both should die before they arrive at the age aforesaid, then the property to be divided equally between my three sons Thomas, Benjamin & James to them & their heirs forever.
Lastly I nominate and appoint my two sons Thomas S. LAND & Benjamin LAND executors to this my last will & testament & desire that they will execute the same - Given under my hand & seal this 11th day May 1836.
