Currituck CountyI Thomas LINDSAY in a low state of health but in a sound and perfect mind and memory do this day make and publish this my last will and Testament in manner and form as follows in the year of our Lord 1856 and in the month of December the 29th day 1856.
Item 1 I give and bequeath to my daughter Margaret JARVIS the following named negroes Ester, Farmon?, Dreary?, John, George, and Obid to her and her heirs forever.
Item 2 I give unto my son David LINDSAY my tract of land known as the Thomas SIMMONS land also all the lands which I purchased from the heirs of Thomas WILLIAMS dec’d also one negro woman Mariah to him and his heirs forever.
Item 3 I give and bequeath to my daughter Martha Susan one negro man named John also one negro woman named Jane to her and her heirs forever.
Item 4 I give unto my son Daniel LINDSAY one negro man Willias also one negro girl Harriet also Hannah and Haneable to him and his heirs forever.
Item 5 I give unto my daughter Delia MILLER one negro woman named Huldah also one girl named Chloe also two hundred and fifty dollars cash to be paid out of my estate.
Item 6 It is my will that my executor shall sell my B.T. SIMMONS tract of land the same I received of from him in exchange with all other lands belonging to me and divide the proceeds equally between my daughter Martha Susan LINDSAY and my son Daniel LINDSAY to them and their heirs forever.
Item 7 All the rest of my property I leave for my executor to sell at his discretion and out of the proceeds pay all my just debts and the balance if any be equally divided among all my children.
Item I hereby make and appoint John BARNARD executor to this my last will and testament in witness whereof I hereby set my hand and seal the day and date above written

The foregoing paper writing purporting to be the last will and testament of Thos. LINDSAY dec’d is exhibited in open court by John BARNARD the executor therein named & the due execution thereof by the said Thos. LINDSAY is proved by the oaths of John SIMMONS & David RAND the subscribing witnesses thereto, it is therefore considered by the court that the said paper writing and every part thereof is the last will and testament of the said Thos. LINDSAY dec’d and the same is ordered to be recorded & filed and thereupon the said John BARNARD executor as aforesaid duly qualified as such taking the oath requiredAttest: J.W. BAXTER, CCC
