I Charles Lewis MAGNENAT being of sound and rational mind considering the uncertainty of life do make constitute & declare this to be my last will & testament.

1st - It is my will that after paying my just and legal debts, all the remaining portion of my property or its value be paid to my son Paul MAGNENAT - said son was born 20th day of July 1847 of Louisa BOCHENNS?.  If he [smudge] not be found or is not living, then it is my will that my sister Adde HAUTRIN? nee MAGNENAT shall [smudge] paid the same.

I hereby constitute & appoint W.H. COWELL my [smudge] executor to take charge of my affairs and fulfill the above condition.

Witness my hand & seal May 24th 1866.

Currituck County}    August Term 1866
    This foregoing paper writing purporting to be the last will & testament of C.L. MAGNENAT, deceased, is exhibited for probate in open Court by W.H. COWELL, the executor therein named, and the due execution thereof by the said C.L. MAGNENAT is proved by the oath and examination of A.J. MORGAN, one of the subscribing witnesses thereto - and that the other subscribing witness therein, R.W. McINTOSH, is very? sick and unable to attend Court.
    It is therefore considered by the Court that the said paper writing and every part thereof is the last will & testament of the said C.L. MAGNENAT and the same is [smudge] to be recorded and filed.  And thereupon the said W.H. COWELL, executor as aforesaid, duly qualifies as such by taking the oath required by law.

[NOTE: The New York Passenger and Immigration List states Charles Louis Magnenat, age 43,  arrived at the Port of New York on Feb. 1, 1849 on the ship Mediator.  Port of departure was listed as London and Portsmouth but the ship had originated in Switzerland..  North Carolina Naturalization Index 1792-1862 by Betty J. Camin states Charles Lewis Magnenot was naturalized in North Carolina in 1854.  C.L. Magnenat, age 55, is living in the Tulls Creek Dist. of Currituck County in 1860.  His occupation was a merchant and he was born in Switzerland.  Two others lived with him in 1860 -- John Harrison, age 32, listed as a miller and Thomas Lee, 21, listed as a seaman.
