North Carolina Currituck County April the thirtieth one thousand eight hundred and five In the name of God Amen I Samuel MIDYETT of the County and State afrsaid being in weke of body but of perfect mind and memory thanks be to God for it [torn] and the mortality of my body and knowing that it is appointed once for all men to die do make and ordain this to be my Last Will and Testament that is to say first of all I recommend my soul into the hands of Almighty God that gave it me [torn] and my body I recommend to the earth to be buried in a christian like manner and at the discretion of my executors nothing doubting but at the general ressurection I shall receive the same by the mighty power of Almighty God and as touching such worldly estate as it shall be pleased to bless me with in this life I will devise and dispose in manner and form here after written
First my will is that all my just debts and funeral charges be paid and satisfied [torn] estate then.
Item: I give to my beloved [torn] woman called Isabel in during her natural life [torn] she and her increase to be equally divided between William Seth and Sabrey to them and their heirs torn[torn] to my [torn] the old negro woman [torn] her natural life and then to be [torn]
Item: I give to my beloved Wife the fourth [torn] stock of cattle sheep and horses hogs to her [torn] forever
Item: I give to my beloved Wife the fourth [torn] household furniture with within doors to her and her [torn]
Item: I give to my beloved Wife a privilege [torn] Bodys Island during her natural life.
[torn] bequeath to my Daughter Mary ASHBEE ten [torn] and her heirs for ever.
Item: I give to my beloved [torn] MANN ten shillings to her and her heirs forever
[torn] bequeath to my beloved Son Thomas MIDYETT [torn] him and his heirs forever.
Item I give and bequeath to my beloved Son William MIDYETT one sailing boat to him and his heirs for ever.
Item: I give to my Son William MIDYETT three negroes Fender, Will and Hanor to him and his heirs for ever.
Item: I give to my beloved Son William MIDYETT the fourth part of all my stock of cattle horses sheep and hogs to him and his heirs for ever.
Item: I give to my beloved Son William MIDYETT the fourth part of all my household furniture within doors to him and his heirs for ever.
Item: I give to my beloved Son Samuel MIDYETT two negroes Cungu(?) and Leon to him and his heirs for ever.
Item: I give to my beloved Son Samuel MIDYETT the fourth part of all my stock of both cattle horses sheep and hogs to him and his heirs for ever.
Item: I give to my beloved Son Samuel MIDYETT the fourth part of all my house hold furniture within doors to him and his heirs for ever.
Item: I give to my beloved Son John MIDYETT three negroes Ellick Boson and Isaac to him and his heirs for ever.
Item: I give to Son John MIDYETT the fourth part of stock both of cattle, horses sheep and hogs to him and his heirs for ever.
Item: I give to my Son John [torn] of all my household furniture within [torn] heirs forever.
Item: I give to my [torn] working tools of every kind to him and his [torn]
Item: I give to my beloved Son John MIDYETT [torn] my estate within doors and without doo [torn] to him and his heirs for ever. And [torn] appoint John MIDYETT my Son to be my [torn] to this my Last Will and Testament [torn] I do hereby acknowledge this to be my last will [torn] and do hereby revoke all other [torn] so ever. In witness whereof I have this day [torn] hand and seal the day and year [torn]

Note: No probate date nor Clerks name is given in this Will. Probate date is from Currituck County Court of Pleas and Quarter Sessions Minutes. In court minutes, testator is referred to as Saml. MIDYETT, SR. and witnesses are Nathl. OWENS, Lewis MIDYETT and Benjamin MIDYETT.
