A paper writing purporting to be the last will and Testament of Samuel ONEAL and to be signed by said Samuel ONEAL name and mark thereto and to be witness by John SIMMONS and B.T. GRAY dated 16th of March 1849 is produced in open court by Benjamin T. SIMMONS and it is due and formal execution as a last will and Testament passing real and personal estate by the oaths of SIMMONS, & GRAY subscribing witnesses thereto who proved the execution there of by said Samuel ONEAL that he declared at the time that the same was his last will and testament that he was at that time of sound mind & memory and that they signed the same as subscribing witnesses in his presence. It is ordered that said paper writing be and it is admitted to probate as a will passing both real & personal estate at the same time B.T. SIMMONS executor thereto appeared and qualified as executor. Let letters testamentary issue.
In the name of God Amen. I Samuel ONEAL of the County of Currituck and State of North Carolina being in a sound mind and memory do this the 16th of March 1849 make and publish this my last will and testament in manner and form as follows viz:
Item 1st I give and bequeath unto my beloved Wife Sally the land and plantation that I now live on also all the furniture in my dwelling house, also one negro woman Peggy and her increase, one negro man York, also one man Miles, also her choice of horses and horse cart, also one yoke of oxen and cart and 4 the first choice of cattle and eight the first of hogs, also five the first choice of sheep, also I give her one years provision out of my estate also ten dollars worth of kitchen furniture to her and her heirs forever.
Item 2d I give to my son Samuel ONEAL all of my land that I possess in the back woods. Also one negro man Isaac to him and to his heirs forever.
Item 3d I give all the rest of my estate to be equal divide between the heirs of Spence ONEAL, N. ONEAL, William GREGORY and Lovey BUNNILL, Penny SIMMONS and Betsy HOLLOWAY to them and their heirs forever.
Lastly I nominate and appoint my friend Benjamin T. SIMMONS executor to this my Last will an Testament ratifying and confirming this and no other to be my last will and Testament in witness my hand & seal.
