In the Name of God Amen, the twelveth of November I Robert OVERTON being Sick in body but of Good And perfect Memory thanks be to almighty God And Calling to Remembrance the Uncertain State of this transitory Life And that all flesh Must Yield Unto death to him? it Shall please God to Call, do make Constitute ordain And Declare this my Last will & testamt in manner And form following Revokeing And Annuling by these presents all & Every testament and testamts will & wills heretofore by me Made and Declared Either by word or writting And this to be taken only for My Last Will And testament And none other and first Commiting My Soul into the hands of Almighty God And My body Where My Executors Shall please to bury it I do also order Give and dispose My worldy Estate in manner and form following,
Item I Give And bequeath Unto My well beloved Wife Ales all my Stock And household goods within doors And without That is to Say all My Whole Estate at her own Disposing Dureing her Widdowhood And afterwards to be Equally Divided Among My Children that is them Sirviving I do also Make ordain Constitute and appoint My Well beloved wife Ales my whole and Sole Executor to this this [sic] My Last will and testament in Witness Whereof I have here unto Set My hand and Seal the 12th day of November 1750.

These may Certifie that James BURNHAM & Caleb SIKES Appeared in Open Court and made Oath that they were present and Saw Robert OVERTON Sign Seal publish & Declare the Within to be and Contain his Last will and Testament & that they saw Ephraim BRIGHT Sign as Evidence thereto and that the Said Robert OVERTON was then and at that time of Sound and Disposeing Memmory. Then also appeared Alice OVERTON his wife as Executrix in Open Court and took the Executor Oath in Due form of Law. Ordered that the Honble James MURRAY Esqr Secretary of the Said province Have notice thereof that Letters Testamentory Issue thereon as the Law Directs.
