Lucinda Owens

Know all men by these presents that I Lucinda OWENS in the County of Currituck and State of North Carolina being in good health of Sound mind and disposing mind and memory do make and publish this my last Will and Testament hereby revoking all former wills by me at any time heretofore made as to my worldly estate and all the property real personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my deceased I devise bequeath and dispose thereof in the manner following to wit:
all of my just debts and funeral expences shall first by my executors hereinafter named be paid out of my estate as soon after my deceased as shall by them be found convenient.
I give
deviseand bequeath to mybelovedson Little Hodges GALLOP one half of the HALL tract of land commencing at the ditch about the middle of the field said ditch being the line straight across the field from James EVANS land to James B. SAWYERs land being the westard End to the main road to have and to hold the same to his and hisexecutorsheirsadministratorsand assigns forever.I give and bequeath to my son Marion GALLOP one half of the HALL tract of land being the north East part of the tract where the house stands from the Sound to the ditch about the middle of the field Said ditch being the line binding James EVANS on the South and James B. SAWYER on the North except a road binding James EVANS land to the Sound as a privilidge to the Sound for which I give my son Little Hodges GALLOP to have and to hold Said lands to his heirs and assigns forever.
I give and bequeath to my Grand Child Martha Ann OWENS one hundred dollars to be paid by my son Little Hodges GALLOP out of the land which I give him Said amount to be paid her twelve months after she becomes to the age of twenty one years if she should die before that time and leave any heirs the amount to be paid to Said heirs if no heirs the Said amount to remain in the hands of my son Little Hodges GALLOP.
I give and bequeath to my Grand Child Clara L.E. OWENS one hundred dollars to be paid by my son Marion GALLOP out of the land which I give him said amount to be paid to her twelve months after she becomes to the age of twenty one years if she should die before that time and leave any heirs the amount to be paid to Said heirs if no heirs the Said amount to remain in the hands of my son Marion GALLOP.
all the rest and residue of my Estate personal and mixed of which I shall died seized and possessed or to which I shall be entitled at my decease I give devise and bequeath to be Equally devided betwen and among my Said sons Little Hodges GALLOP and Marion GALLOP and lastly I do nominate and appoint my Said sons Little Hodges GALLOP and Marion GALLOP to be the executors of this my last will and testament.
In testimony whereof I the Said Lucinda OWENS have to this my last will and testament Subscribed my name and affixed my seal this the Eleventh day of November in the year of our lord one thousand Eight hundred and Eighty six.

OWENSWhereas I Lucinda OWENS have neglected to give my niece Clara Lillian GUARD in the above will any of my personal property I now give and bequeath to my Said niece one bed to be given her by my said Executors after my decease this the Eleventh day of November one thousand Eight hundred and Eighty six.
Signed Sealed published and declared by the said Lucinda OWENS as and for her last will and testament in the Presence of us who at her request and in her presence and in the Presence of Each other have Subscribed as witnesses thereto.

PROBATE OF WILL WITH EXAMINATION OF WITNESSES THERETO

A paper writing purporting to be the last will and testament of Lucinda OWENS, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by Little Hodges GALLOP one of the executors therein mentioned, and the due execution thereof by the said Lucinda OWENS is proved by the oath and examination of Alex OWENS and Martha H. OWENS the subscribing witnesses thereto, who, being duly sworn, doth depose and say, and each for themselves deposeth and saith that he & she is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Lucinda OWENS that the said Lucinda OWENS in the presence of this deponent, subscribed her name at the end of said paper writing, now shown as aforesaid, and which bears day of the 11th day of Nov. 1886.
And the deponent further saith, that the said Lucinda OWENS the testator aforesaid, did, at the time of subscribing her name as aforesaid, declare the said paper writing so subscribed by her and exhibited, to be his last will and testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that a the said time when the said testator subscribed her name to the said last will as aforesaid, and at the time of deponent's subscribing his & her name as an attesting witness thereto, as aforesaid, the said Lucinda OWENS was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.

I, Little Hodges GALLOP, do solemnly swear or (affirm) that I believe this paper writing to be and contain the last will and testament of Lucinda OWENS that I will well and truly execute the same by first paying his debts and then his legacies, so far as the said estate shall extend, or the law will charge me, and all other duties pertaining to the office of Executor I will discharge according to law, to the best of my skill and ability. So help me God.

Currituck County } In re Estate of Lucinda OWENS, dec'd.A paper writing purporting to be the last will and testament of Lucinda OWENS, decd., is exhibited for probate by Little Hodges GALLOP, executor therein named; and the due execution thereof by the said Lucinda OWENS, decd., duly proven by the oath & examination of Alex OWENS and Martha H. OWENS, subscribing witnesses thereto; and it is further shown to the satisfaction of the Court by said witnesses that the said Lucinda OWENS was at the time of making said will, of sound mind and memory, of full age to execute a will, and under no restraint to their knowledge information or belief.
It is thereupon considered, adjudged & decreed that said proof is sufficient and that said paper writing is and contains the last will & testament of Lucinda OWENS, decd. And on motion it is ordered that said will be admitted to probate and recorded in the Book of Wills of Currituck County and as such filed as provided by law in the office of Clerk Superior Court of said county.
It is further ordered that said Little Hodges GALLOP be allowed to qualify as executor as provided by law and enter upon the discharge of the duties imposed by said trust. Dated this the 17th day of March 1899.

In the Matter of the Last Will of Lucinda OWENS, dec'd
Little Hodges GALLOP being duly sworn, doth say: That Lucinda OWENS, late of said county, is dead, having first made and published her last will and testament; and that Little Hodges GALLOP is one of the executors named therein.
Further, that the property of the said Lucinda OWENS consisting of household & kitchen furniture is worth about $20.00 so far as can be ascertained at the date of this application; and that Clara FORBES, Martha A. OWENS, Marion GALLOP and Little Hodges GALLOP are the parties entitled under said will to the said property.
