Mary Janette Waterfield
Oct. 14, 1892 - Jan. 23, 1895

In The Name of God Amen.

I Mary Janette WATERFIELD of the County of Currituck and the State of North Carolina, being weak in body but sound in mind and memory and knowing the uncertainty of this transitory life, and the Certainty of death, do make and publish this is my last Will and testament To Wit.  First, I do order after my decease that my funeral expenses be duly and all of my lawful debts paid as soon as Conveniently as can be.

Secondly.  I leave all I possess to my beloved husband Reubin P. WATERFIELD both real and personal property during the term of his natural life, and it is my Will the two Children which I leave Shall be under his Control and that he Shall enter Guardian for them until they Shall arrive at the age of twenty one years.

And I hereby nominate Constitute and appoint my beloved husband Reubin P. WATERFIELD to be my Executor to this my last Will and Testament and revoking all others heretofore by me made.

In witness my hand and Cause my seal to be affixed in the year of [our] Lord one thousand eight hundred and ninety two.  The 14th day October.

  PROBATE OF WILL WITH EXAMINATION OF WITNESSES THERETO

State of North Carolina}    SS.  In the Superior Court
     Currituck County    }
    A paper writing purporting to be the last will and testament of Mary Janett WATERFIELD, deceased, is exhibited before me, the undersigned Clerk of the Superior Court by Reuben P. WATERFIELD, the executor therein mentioned; and the due execution thereof by the said Mary Janett WATERFIELD, is proved by the oath and examination of W.A. COOPER and William E. BONNEY the subscribing witnesses thereto; who being duly sworn, doth depose and saith and each for himself deposeth and saith the he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Mary Janett WATERFIELD and she in the presence of this deponent, subscribed her name at the end of said paper writing now shown him and which bears date of the 14th day of October 1892.  And the deponent further saith, that he said Mary Janett WATERFIELD the testator aforesaid, did at the time of subscribing her name as aforesaid, declared the paper-writing so subscribed by her and exhibited, to be her last will and testament.  And this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of the said testator.  And this deponent further saith that at the said time when the said testator subscribed her name to the said last Will as aforesaid that the said Mary Janett WATERFIELD was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent.  And further these deponents say not.

EXECUTOR'S OATH

State of North Carolina}    SS.  In the Superior Court
    Currituck County     }
    I, Reuben WATERFIELD do solemnly swear or (affirm) that I believe this writing to be and contain the last Will and Testament of Mary Janett WATERFIELD deceased; and that I will well and truly execute the same by first paying her debts and then her legacies, as far as the said estate shall extend, or the law will charge me; and that I will well and faithfully execute the office of an executor agreeable to the trust and confidence reposed in me, and according to law, so help me God.
