The last Will and Testament of Hillary WHITE was exhibited in open court and proved by the oaths Henry WHITE jurat and Leven WHITEHURST jurat at Feb. Term 1839 subscribing evidences thereto and Henry WHITE Executor qualified in due form of law and ordered recorded.

   In the name of God Amen. I Hillary WHITE of the State of North Carolina and County of Currituck being of a sound and perfect mind and memory blessed be God, on this the fifth day of December in the year of our Lord one thousand Eight Hundred and thirty Eight do make and publish this my last Will and Testament in manner following that is to say.

   First I lend unto my beloved Wife Mary WHITE my plantation I now live on during her widowhood or life time and after her marriage or decease I give and bequeath unto my son Caleb WHITE my land and plantation I now live on.

   Item. I give unto my Wife Mary Mary [sic] WHITE one bed and furniture. Item lend unto my Wife Mary WHITE one mare and one set of stool chairs, and one side board. I also lend unto my Wife Mary WHITE one negro woman by the name of Lydia during her widowhood or life time. I also give unto my Wife Mary WHITE two cows and calfes of the first choice.

   Item I give unto my daughter Betsy WHITE one peace of land that I bought of William BONNEY containing nine acres and after the marriage or death of my Wife I give unto my daughter Betsy WHITE one negro woman by the name of Lydia.

   Item I give unto my son Hillary WHITE one negro man by the name of Toney and one ???? and bed and furniture one yoke of steers, one chest and one gun.

   Item I give unto my two children Jesse WHITE and Frances WHITE my plantation that I bought of James WHITEHURST to be equally divided between them and my son Jesse WHITE is to have the north part and my daughter Frances to have the south part.

   I leave my negro man Cader to be sold and what he fetches and what my notes and money to be equally divided between my two daughters Lydia COFFEE and Mary WHITE.

   I give unto my daughter Mary WHITE one bed and furniture and one chest.

   I leave the remains of my property estate to be sold and equally divided between my Four children Hillary WHITE, Caleb WHITE, Betsy WHITE and Frances WHITE.

   I likewise Constitute make and ordain my only and sole Executor Henry WHITE of this my last will and testament in witness whereof I have hereunto set my hand and seal the day and date above mentioned.

Signed sealed published pronounced and declared by the said Hillary WHITE as his last will and Testament in the presence of us the subscribers
