I S.E. Mann, of Dare County, North Carolina being of sound and disposing mind and memory do hereby make, publish, and declare this my last will and Testament, hereby revoking and canceling all previous Wills and Testaments by me made.

Item One.  It is my will and desire that at my death my executor hereinafter named shall give my body a decent burial and shall pay all my just debts out of the first moneys of my estate that may come into his hands.

Item Two.  To my beloved wife, Virginia D. Mann, I hereby give, devise and bequeath for the term of her natural life the homeplace, upon which we now reside, the same to include the houses. Outhouse and all the land contained within the enclosure at the said home place as it now is. Also, I give and bequeath to my said wife, Virginia D. Mann, the sum of Six Hundred Dollars in cash, the same to be paid by my Executor herein after named out of the first moneys of my estate that may come into his hands as Executor.

Item Three. To my two sons, Carl D. Mann and Joseph C. Mann, in equal shares, I devise and bequeath all the land and improvements thereon of which I may die seized or possessed, to have and to hold the same in equal shares in fee simple forever, subject to the life interest I have above bequeathed to my wife Virginia D. Mann.

Item Four.  I hereby give and bequeath to my beloved daughter Lucy Bell Gard the sum of Three Hundred Dollars, the same to be paid by my two sons Carl D. Mann and Joseph C. Mann in equal shares and to be a charge upon the lands herein devised to them, subject to the directions for securing the same hereinafter set forth.

Item Five.  I hereby give and bequeath to my beloved daughter Callie Lee Hooper Fifty Dollars to be paid by my said sons Carl D. and Joseph C. Mann and to be a charge upon the land herein devised to them.

Item Six.  I hereby give devise and bequeath to my sons Carl D. Mann and Joseph C. Mann all the residue of the real and personal property of which I may die seized or possessed subject to the faithful compliance upon their part of the gifts, devised and bequests herein contained and the faithful compliance upon there part with the purpose stated in the instrument.

Item Seven.  I hereby constitute and appoint my son Carl D. Mann my Executor, without bond, to carry into effect the provisions of this last Will and Testament, with directions that he shall sell any or all the real property herein devised or bequeathed if necessary to do so by reason of the failure of the said Carl D. Mann and Joseph C. Mann or either of them to comply fully with the terms of this Will and Testament, in order to make the cash payments herein bequeathed. Signed and Sealed this the 6th day of December 1919.

    The undersigned, R. Bruce Etheridge and B.G. Crisp do hereby certify that on this day in the presence and at the request of S.E. Mann, Testator, we have subscribed our names as witnesses to the foregoing last Will and Testament of the said S.E. Mann, who has thereto signed his name in our presence, and that our signatures thereto are made in the presence of each other.  This December 6th 1919.

    A paper writing purporting to be the Last will and testament of  S.E. Mann deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for the said County by Carl D. Mann the executor therein mentioned and the due execution thereto by the said Carl D. Mann by the oath and examination of R.B. Etheridge & B.G. Crisp, the subscribing witness thereto who being duly sworn doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of S.E. Mann that the said. S.E. Mann in the presence of this deponent subscribed his name at the end of said paper writing which is now shown as aforesaid, and which bears date of the 6 day of Dec. 1919.
    And This Deponent Further Saith That the said S.E. Mann the testator aforesaid did at the time of subscribing his name as aforesaid,  declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament and this deponent did thereupon subscribe his name at  the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponents subscribing his name as attesting witness thereto, as aforesaid, the said S.E. Mann was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information, or belief of this deponent, And further these deponents say not.

Severally sworn and subscribed this 10 day of Oct 1921 before me

    It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of S.E. Mann, deceased.  Let said Will, together with the probate, be recorded and filed. This 10 day of Oct 1921.
