Be it remembered that I Benjamin W. Oneal of Manteo North Carolina being of sound and disposing Mind, Memory and Understanding, and considering the uncertainty of life, do therefore make, ordain, publish & declare this to be my last will and testament in manner and from following, that is to say:

First:  I hereby revoke and cancel all previous wills & testaments by me made.

Second:  It is my desire that my executor hereinafter named shall pay my funeral expenses and all Just debts, out of any property belonging to me at the time of my decease.

Third:  I give bequeath and devise to my  beloved wife Mary L. Oneal her life time all of my estate real personal and mixed, of whatever nature or kind or whichever situated at the time of my decease including my home place in Manteo, N.C.  One lot in Manteo, N.C. on main street household & kitchen furniture, at the death of my beloved wife Mary L. Oneal, I give devise and bequeath to my daughter  Brancey Oneal Peterson,  My home place in Manteo N.C. One lot in Manteo, N.C. household & kitchen furniture and all other property; both real & personal of whatever nature or kind and  Lastly, I do hereby Make, Constitute and appoint my daughter Brancey Oneal Peterson to be my executor of this my last will and testament hereby revoking all previous wills and testaments it is my desire that my executor herein named shall not be required to give Any bond in the administration of this my last will in witness whereof  I have hereto subscribed my name and affixed my seal this 6th day of October in the year of our Lord, Nineteen Hundred & Twenty Three at Manteo North Carolina.

Signed Sealed published and declared  adjudged for testator above named, as for his last will and testament in the presence of us, who hereto at his request Subscribed our names in his presence and in the presence of each other witnesses hereto.

    A paper writing purporting to be the last will & testament of Benjamin W. Oneal deceased is exhibited before me the undersigned C.S.C of said County by Brancey Oneal Peterson executer therein named and the due execution thereof by said Brancey Oneal Peterson by the oath and examination of E.M. Midgett, W.M. Gray & Etheridge Midgett the subscribing witnesses thereto who being duly sworn doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper now shown him purporting to be the last will and testament of Benjamin W. Oneal that the said Benjamin W. Oneal in the presence of the deponents subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of Oct 6th 1923 and these deponents E.M. Midgett W.M. Gray & Etheridge Midgett saith that the said Benjamin W. Oneal the testator as aforesaid did at the time of subscribing his name as the foresaid declared the said paper writing so subscribed by him and exhibited to be his last will and testament and the deponents did therepon subscribe their names at the end of said will as attesting witnesses thereto and at the request and in the presence of said testator and these deponents further saith that at the same time when the said testator subscribed his name to the said last will as aforesaid and at the time of the deponents subscribed their names as attesting witnesses thereto as the foresaid the said B.W. Oneal was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information, or belief of these deponents, and further these deponents say severally sworn & subscribed.

    It is therefore considered and adjudged by the court that the said paper writing and every part thereof is the last will and Testament of Benjamin W. Oneal deceased.  Let said will together with the probate be recorded and filed.
