{"id":1476,"date":"2010-04-14T03:30:57","date_gmt":"2010-04-14T03:30:57","guid":{"rendered":"http:\/\/ncgenweb.us\/duplin\/?page_id=1476"},"modified":"2010-04-14T04:01:58","modified_gmt":"2010-04-14T04:01:58","slug":"will-of-margaret-williams-1861","status":"publish","type":"page","link":"https:\/\/ncgenweb.us\/duplin\/records\/wills\/will-of-margaret-williams-1861","title":{"rendered":"Will of Margaret Williams (1861)"},"content":{"rendered":"<p style=\"text-align: center\">Submitted by <a href=\"mailto:nerissawilliams1@me.com\">Nerissa Williams<\/a><\/p>\n<p>Margaret Williams&#8217;\u00a0Will<br \/>\nRecorded October<br \/>\nTerm 1861<\/p>\n<p>In the name of God amen I Margaret\u00a0Williams of the County of Duplin and State of\u00a0North Carolina being of sound mind and\u00a0memory but considering the uncertainty of my\u00a0earthly existence do make and declare this my last\u00a0Will and Testament in manner and form\u00a0following, that is to say\u00a0First  That my Executors (hereinafter mentioned)\u00a0shall provide form [sic] my body a decent burial\u00a0suitable to the wishes of my relations and friends\u00a0and pay all funeral expenses together with my\u00a0just debts howsoever and to whomsoever owing\u00a0out of the monies that may first come into their\u00a0hands as a parcel or part of my estate<\/p>\n<ul>\n<li>Item 1st  I give and bequeathe to my Nephew\u00a0Charles Francis Williams all my negroes\u00a0viz Caster Hariet Eliza John George Henry &amp;\u00a0Abram and their increase, to have and told to him\u00a0and his heirs forever<\/li>\n<li>Item 2nd  I give and bequeathe to my brother\u00a0Francis Williams five dollars<\/li>\n<li>Item 3rd  I give and bequeathe to my Brother Branch\u00a0Williams five dollars<\/li>\n<li>Item 4th  I give and bequeathe to my Brother Harper\u00a0Williams five dollars<\/li>\n<li>Item 5th  I give and bequeathe to my Brother\u00a0Robert Williams heirs five dollars<\/li>\n<li>Item 6th  I give and bequeathe to my Brother James\u00a0Williams heirs five dollars<\/li>\n<li>Item 7th  I give and bequeathe to my Brother Blany\u00a0Williams heirs five dollars<\/li>\n<li>Item 8th  I give and bequeathe to the heirs of my\u00a0sister Polly  Cooper five dollars<\/li>\n<li>Item 9th  I give and bequeathe to the heirs of my\u00a0sister Sarah Pridgeon five dollars<\/li>\n<li>Item 10th  I give and bequeathe to the heirs of my\u00a0sister Patience Hunter five dollars<\/li>\n<li>Item 11th  I give and bequeathe to the heirs of my\u00a0sister Rosa Cooper five dollars<\/li>\n<li>Item 12th  My will and desire is that all of the residue of my estate (if any) after taking paying my debts andthe legacies above mentioned shall go to my Nephew\u00a0Charles Francis Williams<\/li>\n<\/ul>\n<p>And lastly, I do hereby constitute and appoint my\u00a0Brother Francis Willliams and my nephew\u00a0Charles Francis Williams my lawful executors\u00a0to all intents and purposes to execute this my\u00a0last Will and Testament according to the true\u00a0intent and meaning of the same and every\u00a0part and clause thereof &#8211; hereby revoking and\u00a0declaring utterly void all other wills and testaments by me heretofore made   In witness whereof\u00a0I have hereunto set my hand and seal this 2nd day of<\/p>\n<p>April AD 1857.              Margaret X Williams (seal)<\/p>\n<p>Signed sealed published and declared by the said\u00a0Margaret Williams to be her last will and testament\u00a0in presence of us who at her request and in her presence do subscribe our names as witnesses thereto<\/p>\n<p>John D Stanford<\/p>\n<p>D M McIntire<\/p>\n<p>State of North Carolina<\/p>\n<p>Duplin County Court. October Term 1861.<\/p>\n<p>The forgegoing and written paper writing\u00a0purporting to be the last Will and Testament\u00a0of Margaret Williams deceased is exhibited\u00a0in open Court for Probate and is duly proved\u00a0by the oath of John D Stanford and David\u00a0M. McIntire, the subscribing witnesses\u00a0thereto. It is therefore considered and adjudged\u00a0by the Court, that the said paper writing is\u00a0the last will and testament of the said\u00a0Margaret Williams deceased and sufficient\u00a0in law to pay the real and personal\u00a0Estate therein devised and bequeathed.<\/p>\n<p>Thereupon Francis Williams and Charles F.\u00a0Williams the Executors therein named\u00a0duly qualifies as such and enters into\u00a0and according to law.<\/p>\n<p>Test John J.
