I Presley S. Williams of the County of Halifax and State of North Carolina, being of sound mind and memory, but in a very feeble State of Health and considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner following: That is to say that my Executor shall provide for my body a decent burial, suitable to the wishes of my family and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owing, out of the moneys that may first come into his hands as a part or parcel of my estate. Item 1. I give and devise to my son J. J. Williams Thirty acres of land adjoining his land, commencing at my gate post my own and his corner and running a straight line to W. H. Thorne's line to have and to hold him and his heirs in fee simple forever. Item 2. I give and devise to my son Gideon P. Williams Twenty five acres to have and to hold him and his heirs forever adjoining his land on the North and West, commencing at a Black (?) and running with Brasits (?) and Price's lines. Item 3. I give and devise to my son Presley S. Williams Jr. Thirty seven acres of land, being that part on which my dwelling house is located to have and to hold him and his heirs in fee simple forever commencing at J. L. Price's line and running to W. H. Thorne's line. Item 4. I give and devise to my daughter Rosanna F. Williams Thirty seven acres of land to have and to hold her and her heirs for fee simple forever adjoining the land willed to my son Presley S. Williams Jr., J. L. Price & W. H. Thorne. Item 5. I give and devise to my wife Mary A. Williams Thirty seven acres or the residue of my home tract adjoining the Lands willed to my daughter Rosanna F. Williams, J. L. Price and W. H. Thorne during her Natural life and then to her five children J. J. Williams, Gideon P. Williams, Presley S. Williams Jr., Rosanna F. Williams and Mary E. Carter, wife of Jesse A. Carter to have and to hold them and their heirs in fee simple forever. Item 6. I give to my daughter Emily E. now Emily E. Reid two dollars to be paid to her out of the first moneys that may come into the hands of my Executor as a part or parcel of my Estate. Item 7. It is my wish and desire that my Land on Bear Swamp be sold and One hundred and Eighty dollars of the Purchase money be paid to my daughter Mary E. Carter, wife of Jesse Carter and the residue if any together with all my money and property of every description be equally divided between my wife Mary A. Williams, my sons J. J. Williams, Gideon P. Williams and Presley S. Williams, Jr. and my daughters Rosanna F. Williams and Mary E. Carter. It is also my wish and desire that my share of the present crop now growing be divided equally between my wife and my daughter Rosanna F. Williams after all Expenses are paid and that the management of the same may continue as began and lastly I do hereby constitute and appoint my son J. J. Williams my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof - hereby revoking and declaring utterly void all other wills and testaments heretofore by me made. In witness whereof I the said Presley S. Williams Sr. do herein to set my hand and seal this sixteenth day of May A.D. one thousand eight hundred and seventy nine . Presley Williams ("X" his mark) Signed, sealed, published and declared by the said Presley S. Williams Sr. to be his last will and testament in presence of us who at his request in his presence and in the presence of each other do subscribe our names as witnesses thereto.

State of North Carolina, A proper writing purporting to be the last will and testament of Presley Williams, late
of said County, deceased, is exhibited for Probate in open Court by J. J. Williams the Executor therein named and the due execution thereof by the said
Presley Williams is proved by the oath and examination of E. B. Perry and Robert Brinkley the subscribing witnesses thereto. It is therefore considered
by the Court that the said paper writing and every part thereof, is the last will and testament of the said Presley Williams and it is adjudged by the
Court that the same is sufficient to pass both real and personal property and the same is ordered to be recorded and filed. And thereupon the said J. J.
Williams, Executor aforesaid, duly qualified as such by taking and subscribing the oath required by law. John Green |
